Complaint

Company will not stop sales calls.

I purchased a vehicle about 4 years ago from Husker Auto. I have since moved out of state, but I continue to receive calls from different salespeople asking me to sell or trade my car with them. I have asked to be removed from the list a number of times, but have received additional calls even the same week. I contacted Husker Auto again on Tuesday, ******* and asked to speak to someone with some authority to remove me from the sales team call list and was directed to Mr. ********* who did not take my call. I was then directed to marketing where a woman took note of my problem and assured me she would pass the message along and have me removed. I received another sales call on Thursday of that week.

Desired Settlement

Please remove me from all contact lists, including phone calls, email and mailings. I DO NOT want any further contact with Husker Auto Group.

Business Response

Husker Auto Group is sorry for confusion. We have removed Ms. ****** from all of our systems. We had removed her from our system on the **** but her name was still in a cue we had to send to corporate to have her name removed. I have been assured by our corporate office that ****** ****** has been removed from all of our data bases.

I went in with preapproval on the CUDL system, but they change financing to a lender out of state with no approval or documentation.

I confirmed that HAG uses the CUDL (credit union & dealer auto lending network) system. I emailed a copy of my approval certificate to the dealer AND brought a copy with me. The first deceptive practice was trying to get me to sign a form showing ****% rate. I showed them my certificate from ******* at ****% and they went back and changed the form. The second deceptive practice was not explaining that they had inexplicably changed the lender from my credit union (2 minutes from my office) to ******************************* in **********. A month later I get a statement from **** telling me my first payment is due. Two minutes later I am at the credit union, they call ****, make arrangements to pay them off in full, but it costs me lien and title fees. Another month goes by, another statement from ****, telling me a have a balance of $*****, but no balance due. This lender seems very shady. My assumption is that HAG secured the loan for a lower percentage, then pockets the difference.

ADDITIONAL DETAILS:

Case is being handled by another organization: ******** AGO

Desired Settlement

I want a written apology from HAG for their deceptive practice.

I want HAG to immediately stop this deceptive practice. I am sure there are legal requirements for them to disclose the financier at time of contract.

I want some money back for wasted lien and title fees, as well as several hours taken off from work to chase all this mess down.

IF this has impacted my excellent credit rating even slightly, I will pursue legal action.

Business Response

We have been in contact with Mr. ******* and have come to an understanding. We will be sending Mr. ******* a check for ****** per our agreement.

Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

They did not address my concern about the impact to my credit rating.

Guarantee / Warranty Issues Read Complaint Details

Complaint

I wish to return a “remanufactured” computer they sold me, after being sent 2 defective units. They carry a 1 year warranty.

I purchased a “remanufactured” computer from their online website. These computers carry a 1 year warranty in the purchase price. I was sent the first computer, that was the wrong part number and also defective. I verified the computer was the issue with a junkyard computer that runs the vehicle perfectly. I returned the first computer and they sent me another computer, this one was the right part number, but again defective. After 2 defective units in a row I contacted and asked to rather return the item for a refund than receive more questionable quality computers from their service. They are claiming that they’re refund policy only allows returns for the first 30 days and it is stated on their website. www.autocomputerexchange.net The only policies I can find related to return on their website are as follows: “Q. Can I return my computer if it doesn’t work?

A.The part may be returned within 14 days of delivery as long as it is returned in its original condition. The return will be subject to shipping charges as well as programming charges. It is up to you and your mechanic to make sure that you diagnose your vehicle correctly.”

This policy by saying it is not their responsibility if you improperly diagnosed the vehicle, does not apply in this case. It was not my diagnosis that was wrong, but their product that is defective. Again this product carries a 1 year warranty for all defects in their workmanship. After a pattern of faulty products I do not trust their workmanship or services anymore and would simply like my money refunded. I have sent them multiple emails trying to explain this and they keep giving what seems to be the same generated email about their 30 day return policy being on their website.

Setting a Budget

Understanding your budget and getting a good price from the dealer is crucial if you don’t want the car buying experience to leave a bitter taste in your mouth. Look through our tips to get some pointers on making your investment work for you.

  • Set a budget and stick to it, no matter what the dealer or finance company says you can afford.
  • Work out how much cash you realistically have to spend after bond repayments/rent, tax, bills, entertainment and other outgoings have been considered.
  • Besides any repayments on the car itself, you also need to consider other running costs such as fuel bills, insurance premiums and servicing-these will cost you thousands each year.
  • Consider whether you really need a brand-new car. Depreciation is the biggest cost in owning a car, with the biggest drop coming in the first year. If you buy used, even just a one-year-old model, you could save plenty and still have two years of warranty protection left.
  • Use Cars4SA .co.za cars for sale to find out the best used car deals available on cars today.
  • Get the best price for your old car when you trade in, or to make sure you`re not paying over the odds for the second-hand model you`re after.
Meeting Buyers
  • You must look after your own security and your car. It`s always sensible to have a friend or relative around with you.
  • Try to meet potential buyers at your home in daylight hours to give them plenty of time to examine the car thoroughly.
  • Ask to see a driving licence, and make a note of the licence number.
  • Make it clear to the person driving that any speeding fines incurred during the drive will be their responsibility. Keep a log of who`s driving the car and at what times-and be sure you have their name and contact details in case they commit any driving offences.
  • Never allow a potential buyer to drive your car without you. When it`s time for the test drive, get into the passenger seat and then hand over the keys.
  • Allow the buyer to drive on a variety of roads and for a decent amount of time. If you try to cut the test drive short, they might think you have something to hide.
  • Never hand over the car until you have been paid the full price.
  • Wait for a cheque or banker`s draft to clear before handing over the keys-inform the buyer that this will be the case.
  • Prepare two copies of a written sales agreement, and make sure you both sign and date each copy and include the following:
    • Make and model
    • Registration number and VIN
    • Year of registration Mileage [if genuine; if you`re not sure and have no way of finding out, say `mileage not verified`].
    • Agreed sale price and deposit paid
    • Buyer`s name and address
    • Your name and address
    • Note that the vehicle is ‘sold as seen’.
The Paper Work
  • You must inform the Licensing Department of the sale by completing change of ownership document and submitting with copy of ID of your and new owner`s.
  • The new owner should also take the certificate and the car`s service book.
  • Should you have an extended warranty, call the company providing a warranty on the car-either a manufacturer or an independent-to inform it of the new owner`s details.
How to Price Your Used Car for selling

Setting the right price for a used car is almost an art-a blend of research and intuition. Set the right price and you will quickly get the full value of your car. Set it the wrong way and you`ll wait weeks for a call or e-mail from a buyer.

Aim to list your car at a competitive price, but one that`s on the high end of the price range. This allows you room to negotiate and still wind up with a good chunk of change. So decide where you want to close the deal and work backward from there.

There are plenty of tools and resources for finding the sweet spot for pricing your used car. Here`s a step-by-step guide to this important process.

Consider the market

Is your car in demand? Can you ask for top dollar? Is this the right time to sell it? Here are a few general rules to help you answer these questions.

  • Family sedans, while boring to many car enthusiasts, are in constant demand by people who need basic, inexpensive transportation.
  • Getting a good price for a convertible or sports car depends on the season in which you sell it. Sunny, summer-like weather brings out the buyers. If you sell in the autumn and winter, prepare for the process to take longer.
  • Trucks and vans, which people often use for work, sell quickly and command competitive prices. Don`t underestimate their value.
  • Collector cars take longer to sell and are tricky to price. However, these cars can bring good sale prices-if you find the right buyer.

Take into account any other market conditions that might have an impact on your car. For example, if your car gets good fuel economy and petrol prices are high, you will be able to ask more for it than when gas is cheap. Similarly, selling a super-size SUV for top dollar is going to be tough if petrol prices are high.

Check the Pricing Guides

Contact your insurance company to determine the fair value of your car. Prices are adjusted for kilometres travelled, colour, options, condition and even region of the country. And don`t forget to take a look at other pricing guides for comparison sake.

Survey your competition

Review other classified ads to see the asking prices for other cars like yours. Most sites offer advanced searches to find close matches to your vehicle. But keep in mind that these are asking prices, not selling prices, and might just be wishful thinking by the seller. Compare the cars` condition, kilometer reading, geographic location and asking price to your vehicle to guide you in setting the right price.

Price your car competitively

As mentioned earlier, be sure to leave wiggle room for negotiations. Ask for slightly more money than you expect. If you get your asking price, that’s great. But if you have to go lower, it won`t be a terrible loss.

As a private-party seller, however, you don`t want to look like a car dealer.

Tap your intuition

Once you have considered all the hard facts, it`s time to consult your intuition. Perhaps you have a hunch that your car is desirable, or that the time is right for you to ask a certain price. As you do this gut check, remember that it`s always a good idea to err on the side of a higher asking price. If necessary, you can lower the price until you get callers. On the other hand, if you err on the low side, you’ll sell it quickly but won`t get the car`s full value.

Take the time to do some research before you set a price for your used car. If you do your job correctly, the car will almost seem to sell itself.

CVS Pharmacies in Florida:BUSTED!

February 6, 2012 By John
Last Update: February 10th, 2012 at 9:01 pm

Two pharmacies in Florida had their dispensing privileges suspended by DEA after investigation revealed over 3 million oxycodone units dispensed in one year. The national average unit count for a pharmacy dispensing oxycodone (such as oxycontin) is 69,000. Pain medicine detox centers in south Florida may see a surge in demand, as a significant source of supply is shut off.

Two CVS pharmacies in south Florida, just north of Orlando, have been arrested with respect to their ability to dispense controlled substances including oxycodone (oxycontin, ms-contin). Cardinal Health, which was already cooperating with the DEA after a previous citation, was also suspended.

Oxycontin addiction (hydrocodone addiction) has become one of the leading drug addictions in the US. Drug addiction has overtaken car accidents as the leading source of deaths and serious illness in many parts of the country.

The 2010 Substance Abuse and Mental Health Services Administration’s National Survey on Drug Use and Health revealed that teenagers use stolen or resold prescription pain medicines to get high for the first time at an increasingly alarming rate.

The DEA has been investigating south Florida s involvement in the diversion of these narcotics for years, and has been successful is shutting down several layers of illegal and seemingly inappropriate distribution by both legal and illegal operations (such as pharmacies and licensed pain clinics and doctors).

CVS recently distributed a pain medicine doctor blacklist in Florida, asserting its rights to refuse to fill oxycodone and other prescriptions issued by those doctors. At least one of those doctors has filed a lawsuit against CVS, claiming the action damaged the doctor s reputation. Now CVS is the subject of a serious DEA action itself.

each registrant was filling prescriptions far in excess of the legitimate needs of its customers. The average pharmacy in the U.S. in 2011 ordered approximately 69,000 oxycodone dosage units. Collectively, these two pharmacies, located approximately 5.5 miles apart, ordered over three million dosage units during the same year.

The ISOs allege that each registrant knew, or should have known, that a large number of the prescriptions for controlled substances that it filled were not issued for a legitimate medical purpose or were issued outside the usual course of professional practice.

If there is merit to the concerns of the DEA about over-prescribing in south Florida and lack of discretion on the part of the pharmacists at these CVS outlets, CVS will feel the same heat the black listed doctors have encountered. This is the first time a major chain has been implicated in the drug diversion under investigation in Florida.

We have contacted a drug detox center in Palm Beach for comment on the potential impact this action against the pharmacies (and the shutting off of supply of 250,000 hydrocodone units per month in south Florida. We ll update this post when we have more information.

DEA Suspends Pharmaceutical Wholesale Distributor and Retailers’ Ability to Sell Controlled Substances
Recent Efforts Go Beyond Mom and Pop Businesses

Feb 6 ORLANDO, Fla. Mark R. Trouville, Special Agent in Charge (SAC) of the Miami Field Division (MFD), Drug Enforcement Administration (DEA), announced today the issuance of Immediate Suspension Orders (ISO) at Cardinal Health, a pharmaceutical wholesale distributor in Lakeland, Florida, and two of its customers, CVS/Pharmacy #219 and CVS/Pharmacy #5195, both located in Sanford, Florida. An ISO is served pursuant to 21 U.S.C. § 824(d) when a DEA-registered business or individual ( registrant ) constitutes an imminent danger to the public safety and suspends a registrant’s ability to handle or distribute a controlled substance such as oxycodone, hydrocodone and others pending a judicial proceeding.

These actions are part of the DEA MFD’s continuing efforts to combat the state’s prescription drug abuse epidemic and its role as a major source to other states of diverted pharmaceutical drugs. On average, seven people die every day in Florida due to prescription drug abuse, according to the Florida Department of Law Enforcement. The efforts in recent years have included arrests and criminal actions against Florida doctors and individually owned pharmacies that operated outside the scope of legitimate medical purposes.

The ISO against Cardinal Health’s Lakeland distribution center, located at 2045 Interstate Drive, Lakeland, alleges that this distribution center failed to maintain effective controls against the diversion of controlled substances into other than legitimate medical, scientific, and industrial channels, in violation of 21 U.S.C. § 823(b)(1) and (e)(1). Furthermore, it alleges that Cardinal Health failed to conduct due diligence to ensure that the controlled substances were not diverted into other than legitimate channels. The ISO was served at this location on Friday, February 3.

Friday’s operation at the Lakeland facility is not DEA’s first visit. In December 2007, DEA issued an ISO at the location due to its distribution of hydrocodone to ‘rogue’ internet pharmacies. That action, and similar actions at other Cardinal Health facilities across the United States, resulted in a $34 million fine. $16 million of this amount was paid to the United States Attorney’s Office, Middle District of Florida. Since October 2008, Cardinal Health has been operating under an Administrative Memorandum of Agreement (MOA) with the DEA that requires Cardinal Health to maintain a compliance program designed to detect and prevent diversion of controlled substances as required under the Controlled Substances Act and applicable DEA regulations. More details regarding the previous cases against Cardinal Health can be found at www.DEA.gov.

The ISOs served at CVS/Pharmacy #219, 3798 Orlando Drive, Sanford, FL 32773, and CVS/Pharmacy #5195, 4369 W. 1st Street, Sanford, FL 32771, allege, among other things, that each registrant failed to exercise its corresponding duty regarding the proper prescribing and dispensing of controlled substances in violation of 21 C.F.R. § 1306.04(a). According to the ISO, each registrant was filling prescriptions far in excess of the legitimate needs of its customers. This action applies only to the distribution of controlled substances at these two locations and not to other retail products, including non-controlled pharmaceutical drugs.

The DEA Miami Field Division has a long history of working large-scale cases from the bottom to the top of drug trafficking organizations, said DEA MFD SAC Mark R. Trouville. The manner in which we are addressing the current threat from pharmaceutical drugs is no exception. We will continue to investigate all of those involved in the diversion of pharmaceutical controlled substances, regardless of their level in an organization.

Cardinal Health and the two CVS/Pharmacy locations will be given an opportunity for an administrative hearing to determine whether the DEA Certificate of Registration at each of the three locations should be revoked. The final decision will be published in the Federal Register.

Also on Friday, Cardinal Health filed for a Temporary Restraining Order in U.S. District Court in Washington, D.C. seeking to remove their suspension to handle controlled substances and allowing them to resume their activities. The District Court Judge granted Cardinal’s request pending a hearing scheduled for Monday, February 13, 2012.

More than seven million Americans abuse prescription drugs, according to the 2010 Substance Abuse and Mental Health Services Administration’s National Survey on Drug Use and Health. And every day, on average, 2,500 teens use them to get high for the first time, according to the Partnership for a Drug-Free America.

Other DEA MFD efforts include its enforcement operations such as Operation Pill Nation in South Florida, Operation Pill Nation II in Tampa, Operation Medicine Shoppe in Central Florida, and DEA National Prescription Drug Take-Back Day occurring on April 28, 2012.
