Cars in Bankruptcy

Can You Keep Your Car If You File Bankruptcy?

Many people who file for bankruptcy and own a car are allowed to keep it during and after their case, especially if it is used for getting to and from work.

If you are behind on car payments, you may be able to use bankruptcy laws to keep your vehicle in your possession.

Both types of personal bankruptcy address cars, car loans and vehicles you own outright:

  • The automatic stay in bankruptcy is designed to stop repossession. In most cases, this goes into effect right after you officially file for bankruptcy.
  • Chapter 7 bankruptcy exemptions may protect your car from a forced sale.
  • Filing for bankruptcy under a Chapter 13 may allow you to repay your car loan at a more affordable rate so that you don’t lose your car to collectors.

Keep reading or fill out the below form to ask an attorney if a bankruptcy could help you save your car.

Car Loans Under Chapter 7 Bankruptcy

Chapter 7 bankruptcy is designed to help eliminate unsecured debts such as credit cards debt or medical debt, but may provide protection for secured debts such as cars.

If you own your car outright, and owe no debts on it, then your car may be fully protected from repossession or forced sale due to Chapter 7 exemptions.

One important aspect when filing bankruptcy is whether you have a clear title to your car. If you have pledged your vehicle as security for a debt, or if you are financing or leasing a vehicle, you likely have three options for secured car loans when you file Chapter 7 .

1. Reaffirm: A reaffirmation agreement is a contract between you and the car creditor in which you agree to pay the balance owed on your car note, despite the bankruptcy filing.

You continue to make payments and the creditor promises that, as long as payments are made, they will not repossess or take back the property.

Reaffirmed debts are not discharged and the debt survives the bankruptcy.

If you do not make your car payments after you reaffirm the car loan, the car lender can repossess the car and sue you for the deficiency balance.

After the finance company repossesses the car, they will sell the car at the auto auction. Usually the finance company does not get enough money from the auction to pay off your loan. This shortfall is called a “deficiency” and you would still be legally obligated to pay the creditor the deficiency balance.

As you can see, the decision to reaffirm your car loan is a serious financial matter.

Reaffirmation agreements are strictly voluntary. You are not required by the Bankruptcy Code or other state or federal law to reaffirm your car loan. Before entering into such an agreement, you will want to speak to a bankruptcy attorney to make sure that the reaffirmation is in your best interest.

2. Redeem: In Chapter 7, you have the right to purchase or redeem your car from the creditor by making a lump sum payment equal to the car’s fair market value.

The U.S. Bankruptcy Code provides that you must pay the creditor the replacement retail cost of the car. The balance of the debt will be discharged.

For example, assume you own a car worth $5000.00, but owe the finance company $10,000.00. In this circumstance, you could redeem the vehicle by paying the creditor $5000.00 and the remaining balance will be discharged in your bankruptcy.

A local bankruptcy lawyer can advise you on the benefits of redeeming your financed car and identifying lenders that will provide the funds for your vehicle redemption.

3. Surrender: If you cannot afford the monthly payments on your car loan or if you determine that you owe more than the car is worth, you can unload the car and the debt in your Chapter 7 bankruptcy by surrendering the vehicle to the creditor.

Car Leases in a Chapter 7

If you are leasing your car when you file Chapter 7 bankruptcy, you can choose to either continue making the monthly lease payments or surrender the car back to the creditor.

If you surrender the leased car, any obligation to repay debt will be eliminated in your Chapter 7 bankruptcy case.

Car Loans in a Chapter 13 Reorganization

If you have fallen behind on your car payments, you may be able to file a Chapter 13 bankruptcy to stop the repossession of your vehicle. The amount you have to pay for your car depends upon when you bought your car.

If you own your car outright, and owe no debts on it, then your car should be fully protected in Chapter 13.

910 Claims: If you bought your vehicle within 910 days of filing your bankruptcy case, you must repay the entire car loan.

The good news is that the interest rate you pay on your car loan may be significantly reduced.

For example, if you owed $10,000 on a car loan whose blue book value was only $5000, you would be required to pay the entire $10,000 balance if the car was purchased less than 30 months, or 910 days, of filing. In short, debtors who want to keep their cars must pay the full loan amount rather than “cram down” the debt to the value of the car.

Cram Down: If you bought your car more than 910 days before you file bankruptcy, you will only have to repay an amount equal to the present value of the car.

For example, if you owed $5000 on a car that is worth only $2500, upon filing Chapter 13 you would be required to repay the finance company only $2500 over the three-to-five year term of your Chapter 13 repayment plan.

Car Leases Under Chapter 13 of the U.S. Bankruptcy Code

Your car lease usually cannot be paid through the Chapter 13 bankruptcy repayment plan that you devise with your bankruptcy attorney.

You can “assume” the lease and continue making the monthly payments. You can also “reject” the lease and return the car to the creditor.

The creditor will sell the leased vehicle, apply the sale proceeds to your lease balance and then file a claim in your Chapter 13 bankruptcy case for the lease deficiency.

This deficiency is an unsecured, non-priority claim, which means you will likely only pay that creditor pennies on the dollar.

PDF Document Management 14: Add a Digital Signature into PDF Document

A digital signature (ID). like a conventional handwritten signature, identifies the person signing a document. Unlike a handwritten signature, a digital signature is difficult to forge because it contains encrypted information that is unique to the signer and easily verified. It is usually password protected and can be stored on your computer in PKCS #12 file format (Personal Information Exchange File, PFX).

When you buy a new digital signature, you get .spc file that contains the certificate and .pvk file that contains your private keys. U se Microsoft command-line tool Pvk2Pfx to convert them into a PFX file. See detail here.

The following command generates the .pfx file Mypfxfile.pfx from Mypvkfile.pvk and Myspcfile.spc. The command supplies the password mypassword for the .pvk file, which becomes the password for the .pfx file Mypfxfile.pfx:

pvk2pfx -pvk mypvkfile.pvk -pi mypassword -spc myspcfile.spc -pfx mypfxfile.pfx

This function can create document-level Digital Signature that apply to the entire document.

Here are the steps on how to Add Digital Signature into PDF Document.

2. Select a PFX file with digital signature.

3. The Create Digital Signature to Document dialog box comes up:

  • Select a File. Select a PFX file with digital signature.

  • Keystore Provider. Sets the Cryptographic Service Provider that will sign the document. Leave it empty for pkcs12 type.
  • Signed Type. The mode can be Self signed (Adobe.PPKLite). VeriSign plug-in (VeriSign.PPKVS) and Windows Certificate Security (Adobe.PPKMS).
  • Certification Level. The certification level can be NOT_CERTIFIED. CERTIFIED_NO_CHANGES_ALLOWED. CERTIFIED_FORM_FILLING and CERTIFIED_FORM_FILLING_AND_ANNOTATIONS .
  • Reason. Sets the signing reason.
  • Location. Sets the signing location.
  • Contact. Sets the signing contact.
  • Appearance.
    • Visible. Sets the signature to be visible on the Position of the selected Page.
    • Page Number. Select the page number for the digital signature.
    • Appearance: There are 4 Options: Description Only, Signer Name and Description, Signature Image and Description, and Signature Image only.
    • Let/Right/Top/Bottom. The position for the digital signature.
    • Use Signature Image. Set the signature image if the Appearance option is Signature Image and Description
    • Use Background Image. Set the background image. Leave it blank if no background image.
    • Background Image Scale. Set the scaling to be applied to the background image.

4. Click Close to finish.

SharePoint Config database Log file too big – reduce it! #event #log #file #location

SharePoint Config database Log file too big reduce it!

SharePoint Config database logs are one thing to keep an eye on since they do have a tendency to grow. If you don’t perform a full farm backup usually the log doesn’t get emptied and it just keeps bloating.

If you’re running SQL Server Express with default installation, you can find the files in C:Program FilesMicrosoft SQL ServerMSSQL.1MSSQLData

As we see in the example above, even though the database is only 6 megs, the log file grew to 11 gigs. Let’s reduce that:

1. If you don’t have it yet, download and install SQL Server Management Studio express from here .

2. Run the Management Studio and connect to your SQL Server.

3. Expand “Databases” and select your config database “SharePoint_Config”.

4. Right Click it, select Tasks –> Shrink –> Files

5. In the new window select Release unused space and click OK .

If that doesn’t decrease the database size much, do the following:

1. First to be on the safe side, let’s back it up (this step is optional)

type the following:

BACKUP LOG [Sharepoint_Config] TO DISK=’D:configLogBackup.bak’
GO

where SharePoint_Config is the name of your config database file and D:configlogbackup.bak is the location and file name of where you’ll make the backup.

This may take a while if your log file is big.

2. Next clear the query (or click New Query again) and enter the following commands

BACKUP LOG [Sharepoint_Config] WITH TRUNCATE_ONLY
USE [SharePoint_Config]
GO

anc click Execute again

3. Clear the query or open another query tab and enter the next command:

DBCC SHRINKFILE (N’SharePoint_Config_log’. 50)
GO

The 50 in the command above sets the size in MB to truncate the log to. If your config db is of different name, replace the SharePoint_Config part above with your config db name.

And click Execute yet again.

The result you get should be something like below:

and ofcourse the file size:

ahhh. finally some space.

HI my SharePoint_Config_log.LDF file size is increased upto 30 gb and i used the same step and it show me same screen also after running command. But it did not shrink my SharePoint_Config_log.LDF file stil it is showing same size but in i got message that:
Cannot shrink log file 2 (SharePoint_Config_log) because all logical log files are in use.

(1 row(s) affected)
DBCC execution completed. If DBCC printed error messages, contact your system administrator.

Security cameras have long been available on the market, but only recently have they become affordable enough for the average homeowner to use. For homeowners who may not be able to afford the best home alarm companies in the United States. cameras are the next best option. Integrating cameras into your home security system can be beneficial for a number of reasons that are often overlooked!

First and foremost, a surveillance camera can keep bad guys away from your property while you re away from home. Criminals usually case neighborhoods before they opt to rob a certain house. If you have a security camera placed in a prominent spot outside, criminals may simply skip your home and go elsewhere.

In the off chance that your home is a victim of theft, security cameras can help capture the perpetrators or prove that a crime was committed in the first place. In order to be of actual help to police, make sure that you install quality cameras that can capture all details.

Surveillance cameras aren t just helpful in catching criminals and stopping crime. They can be a helpful appliance in keeping an extra set of eyes on your kids or disabled/aging family members. You can access to the footage captured by your camera in remote locations so there s no need to leave work.

Perhaps the most compelling reason to install security cameras is for a peace of mind. You need to know that you ve done everything in your power to protect your home should unforeseen circumstances arise. You will also find that you can save quite a bit of money on your homeowner s insurance policy with a proper security system installed throughout your home.

Is a security camera necessary when you already have an alarm system installed? In our opinion, yes! Modern criminals are handy and they can wreak havoc in your life if you don t take the necessary precautions to keep your family and pets safe.

PaKnPosT Pro File Sharing Facility #corporate #file #sharing

#

Why was PaKnPost Pro written?

Like most software, to scratch an itch. In the corporate world, the size of email attatchments is usually restricted to preserve bandwidth and email server file system resources. This is frustrating for many users who have a legitimate need to send and receive large files. Most people understand email and web browsers, so PaKnPosT leverages this understanding by using HTTP via Web browser to convey files, and text email to notify file recipients. To ease corporate concerns, optional administrative controls feature file type and size restriction, user restrictions, virus scanning, encryption, password protection and anti-spam measures.

How Does It Work?

A user is presented with a Web interface for selecting up to ten files at a time which are uploaded to a unique Holding Area on the PaKnPosT server. The Holding Area is a directory having a randomized name with 1 x 10 to the power of 23 different combinations. The user is then prompted for their name and email address and the email addresses of recipient(s). The recipient(s) receive a plain text email including instructions for retrieving the shared file(s) and a confirmation email is sent to the originator. The PaKnPosT administrator may optionally allow users to password protect the Holding Area and/or strongly encrypt the files in the Holding Area.

The PaKnPosT Pro 1.15 release includes bug-fixes and security enhancements.
CREDIT for discovery of vulnerabilities and patching to Edvin Rustemagic and Grega Preseren, with thanks.

What You Need To Know About File Sharing #file #sharing #security

    #

BitTorrent. uTorrent. The Pirate Bay. These are just a few of the many popular peer-to-peer (P2P) file sharing sites you’ve probably heard of. Since its increase in popularity in the late 1990s, P2P file sharing has had its fair share of backlash for enabling illegal activity. Run a Google News search on peer-to-peer file sharing. and you’d find headlines like:

“Barre man charged with promoting child pornography.”

“Is the free download of uTorrent legal?”

“Illegal downloaders in federal court’s crosshairs.”

There’s another aspect to P2P that has traditionally caused concern: computer security and privacy risks.

If you aren’t careful, P2P file sharing can subject you to spyware, viruses, Trojan horses, worms and identity theft. Some P2P applications can even modify or penetrate your computer’s firewall without detection.

Here’s a look at what P2P file sharing is, why you might use it, and how to stay safe if you do.

    What is P2P File Sharing?
P2P file sharing is the process of sharing and transferring digital files from one computer to another. In a P2P network, each ‘peer’ is an end-user’s computer connected to the other ‘peer’ via the Internet – without going through an intermediary server. To participate, you download and install a P2P software program. Some P2P programs work only with a single P2P network. Others work with multiple networks. Napster was an early and famous example of P2P file sharing.

    Why Use P2P File Sharing?
P2P programs can be an efficient way to share large files with others, such as personal video recordings or large sets of photos. P2P is also used to facilitate direct communications between computer or device users. Chances are you’re already using some form of P2P technology: for example, Skype built its communications systems on P2P technology.

P2P file sharing could play an even larger role in your computer activities in the future. Some believe P2P could serve as a future foundation for legal content delivery. Netflix CEO Reed Hastings (half-jokingly) suggested that the company might use P2P video streaming to sidestep challenges it faces with ISPs like Comcast.

How Can You Stay Safe When Using P2P File Sharing?
    1. Before you start, make sure your computer’s security software is up-to-date
Check that your firewall protection hasn’t been disabled. If a P2P program requests that you disable or alter your firewall’s settings, you’re probably not dealing with a legitimate P2P program. And make sure you have a solid antivirus software up and running to prevent any malware from shared files

    2. Stick to legal file-sharing services
BitTorrent has evolved into one of the most popular file sharing protocols, with plenty of legal content available for download. Other sites offering legal music and movie downloads include Joost, Miro, Babelgum, and BBC’s iPlayer.

    3. Use your computer’s security software to scan downloads
If any files are flagged as risky, quarantine and/or delete them immediately.

    4. Don’t upload (or download) copyrighted material
Want to share your digital copy of Iron Man 3 with the world? Your generosity could get you into costly legal trouble. Media companies have successfully sued college students and others who illegally uploaded copyrighted music, movies, and other content. One famous case was Sony BMG Entertainment v. Tenebaum. which went all the way to the Supreme Court.

    5. Pay attention when you install P2P programs
Often, it’s tempting to check email or Facebook while downloading and installing software. But you should give the downloading and installation of any P2P program your complete attention. Make sure you’re clear which folders on your computer will be made public – you could be exposing private data on your hard drive.

    6. Close the P2P connection when you’re finished
When you close a file-sharing software program’s window, your connection to the P2P network may remain active. This could give others access to your shared files, which in turn may increase your security risks. It’s best to get in the habit of shutting down the program when you’re not using it.

    7. Refrain from using P2P file sharing at work
Unless there’s a valid work-related reason, it’s best to limit your file-sharing activities to your own computers. Employers often have policies against using P2P programs on work computers.

    8. Make sure your kids understand the risks
When unsupervised, kids can wander into ‘bad neighborhoods’ on the Internet. Take a few minutes to educate them about the risks in downloading files off the Internet, and put safe-browsing tools into place.

P2P file sharing has its advantages: by enabling users to connect to each other directly, P2P can use less bandwidth and deliver fast file transfers, often at little or no cost.

But it does come with dangers, so proceed cautiously. Keep our tips in mind when you’re utilizing P2P programs. And if you have any doubts, just don’t do it.

    Time Window for Filing a Car Insurance Claim #how #to #file #a #insurance #claim #on #car #accident

How long do I have to file a car insurance claim?

Here’s what you need to know.

    • How long you have to file a claim depends on the requirements in your policy
    • Before filing a claim, make sure you have necessary documents in order
    • If your policy expires after your accident but before you file a claim, your insurance company still obligated to cover your accident

The amount of time you have to file a car insurance claim can be as much as two or even four years; it truly depends on a number of factors.

First, let’s consider scenarios. Have you been in a fender bender while driving your car lately? Maybe things in your life were already too hectic and you didn’t file a claim at the time of the incident.

Now some time has passed and things have calmed down. Unfortunately, you continue to see that ugly dent in the side of your car. You are now wondering, Can I still file a claim ?

Here is another scenario. What if you were in a very bad accident and had to stay in the hospital for a time? You would need to make sure that you have all your records and medical bills together before filing a claim .

This can certainly take quite a bit of time, especially for a person who is not functioning at 100 percent.

Read on further to learn generally how much time you have to file an auto insurance claim with your car insurance company and then be sure that you enter your ZIP code in above to compare FREE car insurance rates!

The Role of the Insurance Company

Every car insurance provider and every state have different policies and laws as to how much time a motorist has to file a car insurance claim. The best place to look for this information is on your automobile insurance policy contract.

The contract will state in plain words something along the lines that you have X amount of years from the date that an accident occurred to file a claim.

Every policy will be different, and some policies do have a clause permitting the company to reject a claim that was not reported in what they consider a “timely” manner.

It may be in your best interest to contact your insurance provider directly and ask a few hypothetical questions to be on the safe side.

Remember when contacting the insurance company, that they often have their best interests at heart, which usually means giving you the least amount of information as they possibly can.

That said, there are still some excellent and honest insurance providers out there that do care for your interests. Contact your insurance provider so you can get answers to all your questions in an upfront and truthful manner.

Asking a hypothetical question of how long you have after an accident to file a claim should be accompanied by a specific time frame, not a reply of “as soon as possible” with no other details given.

How Laws Differ from State to State

If for some reason your policy does not have a set time, and the agents are unwilling or unable to give you an answer, you may need to check into your state’s laws.

    Look up information on:

    • State precedents
    • The statutes of limitations
    • The amount of time you have to make a claim

This information usually appears right after the statute of limitations. A rough estimate for most states and agencies usually falls between the two- to four-year marks.

The statute of limitations refers to state laws in which a limit is placed on the maximum amount of time you have to pursue legal action against someone or something.

Most companies prefer it if a motorist files a claim right away, as this tends to save the company money due to having fewer details of the accident, and thus lower payouts.

While you should try to file a claim as soon as you have all the documentation together (such as police reports and hospital bills) do not let the insurance company rush you.

You do not want to miss details that will end up costly, due to the fact that you rushed to make a claim. As long as your claim time follows your policy guidelines, you cannot be denied for taking your time and making a shrewd move.

Documenting the Scene of the Collision

There are some precautions to take to ensure the process goes smoothly.

    • Keep a camera in your car and document any damage that happens to it. This may help document and capture evidence that would not otherwise be there.
    • Always contact the police and have them file a police report so you can have additional evidence and proof on your side. You should also seek to ask any witnesses near the scene for their contact information.

Now you know that the amount of time you have to file a car insurance claim all depends on your state and insurance provider.

Under what conditions would my claim expire?

For example, if you are expecting the payout for your totaled vehicle to include coverage for high-performance parts. the insurance company will require you to produce receipts proving that you purchased those parts.

If your time limit is 60 days, and you fail to produce the receipts within that period, your claim could expire.

The good news is that in cases like these insurance companies very rarely terminate your claim in whole.

Instead, they would just forget about the high-performance parts and issue you a payout based on the replacement value of your vehicle. Cases where your claim would be fully terminated include your failure to produce police reports, medical evaluations, doctor bills, and so forth.

As long as you comply with your insurance company s requests in a specified amount of time, you have nothing to worry about.

Is the insurance company required to settle my claim before a certain date?

Different states have different regulations when it comes to this part of the insurance claims process.

For example, California has very specific time requirements for claims settlement, while Iowa simply requires insurance companies to settle within a prompt and reasonable time frame.

That state never defines what prompt and reasonable means, giving insurance companies great leeway to settle claims at their own pace.

Regardless of the state in which you live, if you feel your insurance claim is not being handled promptly or prudently you can always petition your state insurance department to intervene.

Insurance companies are tightly regulated in every state and are subject to regulatory authority.

Even if your insurance company does attempt to settle your claim in a prompt manner, you can still dispute their findings through your state bureau .

Remember that insurance is a contract between you and the provider. If you don t believe your car insurance company is living up to its end, insist that it does through the legal resources available to you.

What if my policy expires the day after I have an accident?

Your car insurance company is required to cover you right up through the expiration date printed on your policy documents. Therefore, even if you have an accident the day before your policy expires the insurance company is still required to honor its commitment.

Keep in mind that they probably won t go out of their way to be prompt should you still decide to let your policy expire. But by law, they can t put you off forever. At some point, the insurance contract requires them to settle up with you.
