LONDON— The Bank of England has rejected calls to scrap new banknotes that contain traces of animal fat. The bank says it will continue to issue polymer notes that contain tallow, a rendered form of animal fat. 8 Epic EHR implementations with the biggest price tags in 2015

Investments in EHR systems are undoubtedly costly, but some implementations appear to carry more costs than others.

Implementation costs vary system to system and hospital to hospital. Prices fluctuate based on what types of additional features and modules a hospital selects. And, according to a Politico report, some EHR vendors charge for additional service fees while others don’t. The Politico report indicates for Epic’s 2014 edition software, the Verona, Wis.-based EHR vendor charges a software licensing fee, implementation costs and annual maintenance costs while OpenVistA, developed by Carlsbad, Calif.-based Medsphere, for example, does not.

Even within the subsector of Epic implementations, costs fall across the board. For example, Duke University Health System, based in Durham, N.C. paid approximately $700 million for its Epic EHR (systemwide go-live in 2014) while Dartmouth-Hitchcock Medical Center in Lebanon, N.H. paid $80 million (go-live in 2011), according to a Forbes report.

John Halamka, MD, CIO of Beth Israel Deaconess Medical Center. said in the Politico report that hospitals selecting Epic’s platform are not just buying a product — they are buying a process. BIDMC does not operate on Epic’s EHR; rather, the hospital earlier this year forged a partnership with athenahealth, which included using the Watertown, Mass.-based vendor’s product.

“Epic is selling a methodology; often a lot of manual processes or heterogeneity and standardizing the work,” Dr. Halamka told Politico. “It’s not that they’re buying expensive software, they’re buying a lot of software.”

No matter where the prices come from, the cost of Epic installations are significant. Here are eight of the most costly Epic implementations reported within the past six months. These are working numbers, with some systems having allotted the indicated amounts to implementation projects and others that have already completed installations.

Partners HealthCare: $1.2 billion
Boston-based Partners HealthCare is one of more recent implementations, going live the first week of June to the tune of $1.2 billion. This is the health system’s biggest investment to date. The implementation process took approximately three years, and in that time, the initial price tag of $600 million doubled.

LehighValleyHealth Network: $200 million
LVHN started its switch to Epic’s platform in February 2015, but the full transition will take between four and six years. Harry Lukens, CIO of the Allentown, Pa.-based system, told The Morning Call the total investment dedicated to the installation includes software, hardware, data conversion and additional personnel.

Mayo Clinic: “Hundreds of millions”
In January 2015, Rochester, Minn.-based Mayo Clinic announced it selected Epic’s EHR and revenue cycle management platforms and planned to drop its Cerner and GE Healthcare contracts to do so. The value of the contract was not disclosed by the health system or the vendor, but stock analysts told The Kansas City Star it is worth “hundreds of millions of dollars over several years.” Additionally, the headline of the Star report reads “Cerner loses Mayo Clinic contract worth hundreds of millions of dollars to Epic,” indicating a ballpark estimate of the new contract’s value.

LaheyHospital Medical Center: $160 million
On March 28, 2015, the Burlington, Mass.-based hospital completed its two-year implementation of Epic’s EHR system. Two months later, Lahey Health said it was laying off 130 people at three hospitals to close the budget gap. In the six months ended March 31, the health system had lost $21 million, partly due to preparatory EHR implementation costs.

Lifespan: $100 million
Providence, R.I.-based Lifespan announced plans to implement Epic’s EHR in March 2013, and the health system went live April 2015. Lifespan initially projected the implementation to cost $90 million, but in a Rhode Island Public Radio report, John Murphy, MD, executive vice president of physician services, alluded to a total closer to $100 million.

Erlanger Health System: $97 million
Chattanooga, Tenn.-based Erlanger Health System signed a contract with Epic in May 2015 nearing $100 million. The health system will invest $91 million in capital expenses, but operating expenses will bring the total to $97 million over the next 10 years. Erlanger was deciding between Epic and Cerner’s platform and ultimately chose Epic because the bid was less expensive, CFO Britt Tabor told Times Free Press .

WheatonFranciscan Healthcare: $54 million
In January 2015, Glendale, Wis.-based Wheaton Franciscan Healthcare announced plans to implement Epic across its hospitals. The system’s affiliated medical group and physician offices have been using Epic’s EHR since September 2012, but providers across the system can only view patient records and not input information. The implementation will create one central EHR platform across the system. Go-lives will begin January 2016. The system expects a return on investment after four years of using the platform.

Saint Francis Medical Center: $43 million
The hospital in Cape Girardeau, Mo. contracted with Epic in February 2015 and expects to go live in July 2016. Saint Francis plans to connect and exchange records with other hospitals in the St. Louis area also using Epic’s system, including SSM Health and Mercy Health.

Worth noting
A handful of other hospitals and health systems reported signing contracts with Epic this year but did not disclose the costs of the IT projects. Some of these organizations include Arlington Heights, Ill.-based Northwest Community Healthcare, SSM Health St. Mary’s Hospital-Audrain in Mexico, Mo. Oklahoma State University Center for Health Sciences in Tulsa, San Diego-based Scripps Health and St. Louis-based BJC HealthCare.

Security Clearance

Security clearances are an increasingly important requirement for federal government employees, employees of government contractors, military personnel and even private sector employees. Security clearance guidelines and standards over the past 10 years have changed, and the number of individuals who require access to sensitive or classified information has significantly increased. In addition, the federal government has required employees who already have security clearances to upgrade their security clearance levels. The process of obtaining, retaining and upgrading a security clearance over the last several years has become more complex due to the security concerns of the United States Government. Our firm serves as security clearance lawyers for individuals encountering difficulties or questions in the security clearance process. We belong to the Security Clearance Lawyers Association.

Security Clearance Application Process

All employees whose positions require access to sensitive information or restricted areas are required to complete an application form known as the Standard Form 86 Questionnaire for National Security Positions (SF-86) or Electronic Questionnaires for Investigations Processing (e-QIP ). Providing information in the SF-86 or e-QIP is voluntary; however, completing the form truthfully is critical to the process of successfully obtaining a security clearance. Once a security clearance application is completed, it is generally submitted to the Defense Security Service (DSS), the individual federal agency s security clearance review office, or the Office of Personnel Management (OPM) for a review and determination.

Public Trust/Suitability Investigations

Federal employment positions often include important duties that do not require a security clearance but are sensitive in nature. For instance, included in public trust positions are certain types of federal police officers, comptrollers, and public safety and health workers. These positions are referred to as public trust positions. They are subject to background investigations, which include a National Agency Check and Inquiries (NACI) review, and potential personal interview and reference checks.

Our law firm also represents and advises individuals in the related area of suitability and public trust positions, which derive from an individual s completion of the SF-85 (Questionnaire for Non-Sensitive Positions) and SF-85P (Questionnaire for Public Trust Positions).

Security Clearance Investigations

The U.S. Government conducts background investigations and reinvestigations of individuals under consideration for a security clearance or for the retention of their security clearance in national security positions. Applying for a security clearance requires an employee to undergo a comprehensive background investigation into all aspects of his or her personal and professional history. The investigation includes interviewing the applicant, checking state and federal criminal databases, and interviewing other persons. An employee’s full cooperation with all aspects of the investigation is a requirement in order for him or her to obtain a security clearance.

If a federal employee or government contractor employee’s initial application is denied, or his or her existing security clearance is revoked or suspended, he or she will be issued a Statement of Reasons (SOR) or will be provided a notice which outlines the reasons why the security clearance was not granted or continued. When the Defense Security Service (DSS), the individual s federal agency security office, or the Office of Personnel Management (OPM) denies an employee’s security clearance, there are procedures or provisions that allow the employee or government contractor employee to appeal the decision, such as a hearing (often referred to as a personal appearance) before the employing agency or the Defense Office of Hearings and Appeals (DOHA) to adjudicate his or her security clearance matter.

Federal employees have the right to appear in person before an administrative judge in a hearing (or other clearance adjudicator) and respond to the allegations in the SOR. Following such a hearing or personal appearance, the administrative judge or adjudicator will issue a recommended decision to the federal agency s personnel security appeals board (PSAB), which will issue the final determination on the federal employee s security clearance. Government contractor employees in DoD cases have the right to a hearing before a DOHA judge. In cases involving DoD government contractors, the administrative judge will issue the initial ruling as to whether the security clearance is granted. A contractor then has a right to appeal an adverse decision to the DOHA Appeal Board.

Intelligence Agency Security Clearance Holders

Electronic Discovery

Electronic discovery (sometimes called e-discovery) refers to any process in which electronic data is sought, located, secured, and searched with the goal of using it as evidence in a civil or criminal legal case. E-discovery can be performed offline on a specific computer (or electronic device) or it can be accomplished in a network. Court-ordered or government sanctioned computer forensics for the purpose of obtaining critical evidence is also a type of e-discovery.

E-discovery is an evolving field that is far greater than just the issue of technology. It can potentially involve multiple legal, constitutional, political, security, and personal privacy issues—many of which have not yet been fully defined by court decision.

Key elements

  • Court decisions dating back a few years, and a more recent court rule change December 1, 2006, require entities to focus on electronic documents that relate to anticipated lawsuits.
  • All electronic data is potentially discoverable (subject to applicable privileges) including but not limited to, e-mail, other active information stored on servers, and back-up tapes/media capable of restoration even if deleted at some prior time.

Key obligations on state agencies

  • Must preserve data whenever there is a reasonable anticipation of a lawsuit.
  • Must suspend the agency routine document retention/destruction policy.
  • Identify key players who may have relevant documents.
  • Identify all sources (computers, jump drives, Blackberry etc) of relevant documents.
  • Put a written ‘litigation hold’; in place directing preservation of all the relevant documents wherever located.
  • Make the agency IT department aware of the litigation hold.
  • Preserve everything until it can be reviewed with counsel any and all decisions including those about subject matter of documents, the key players, the time frame, whether stored data such as back up tapes/media are accessible or inaccessible, and how these will be preserved.
  • Draft a written preservation plan and review it with counsel – it is the agency plan and the agency has the responsibility to see that it is followed. Do not attest that the agency has made a ‘diligent search’ without a written outline describing what the agency did. Review that outline with agency lawyers – get advice on the adequacy of the agency’s efforts.

Continuing state agency obligations

  • Quarterly follow up for the duration of the dispute/lawsuit to be sure that documents are identified and retained on a continuing basis.
  • Follow the agency lawyer’s preservation related instructions on an ongoing basis.
  • Send periodic written reminders to key players of obligations.

Consequences of failure to meet obligations

  • Payment of the opposing party’s legal costs
  • Serious monetary sanctions
  • Preclusion of evidence
  • Adverse inference instructions
  • Default judgment
