    Some families are dysfunctional, but not American Family Insurance. The insurer received high marks from its members in this year’s survey. They landed an overall score of 84.6, and individual numbers were high as well. American Family was given a 4.5 for its claims processing, and its members were happy with customer service (4.25) and the value for price (4). There may be some reservations among some customers, with 82 percent being happy to recommend the company. Still, 92 percent say that they will renew.

    Minimum Requirements for Car Insurance in New York

    • The New York DMV states that every driver in New York must carry a minimum of liability coverage on their vehicle.
    • New York Liability Coverage minimums:
      • $25,000 for individual injury and $50,000 for individual death in a car accident.
      • $50,000 for multiple individuals injuries and $100,000 for multiple deaths in a car accident.
      • $10,000 for property damage.
    • New York requires a vehicle to be insured in order to register the vehicle in the state. Also, the name on the insurance and registration paperwork must match.

    New Driver Licensing Requirements

    To operate a vehicle in the state of New York, a driver must be 16 years of age or older and have a valid drivers license. If the driver is under 18, the driver must follow the restrictions listed on the New York DMV website. The following lists the requirements to obtain a NY drivers license.

    • Vision Test.Every driver must pass the vision test with a visual acuity of 20/40 or better. An applicant can have the test performed by any of the following professionals:
      • Physician
      • Physician s assistant
      • Ophthalmologist
      • Optician
      • Registered nurse
      • Nurse professional

      A Vision Test Report must be submitted by the professional or by the vision care provider listed in the DMV Online Vision Registry. If it is determined that the applicant requires corrective lenses, a license with a B restriction may be issued. Two other vision restrictions include:

      1. Telescopic Lenses: A Telescopic Lenses restriction can be placed on a drivers license after the applicant submits an Eye Test Report for Medical Review Unit form.
      2. Daylight Driving Restriction: This restriction can be placed on a driver s license if the vision professional determines their night vision is impaired.

      Each vision restriction can be removed by taking the necessary steps listed on the NY DMV website.

    • Written Test. Access the Driver s Manual and Study Guide to prepare for the written test. An applicant must complete either a Driver Education Course, a Pre-licensing Course or pass the written test prior to scheduling the road test.

      If the applicant is under age 18, 50 hours of supervised driving experience must be documented with a Certificate of Supervised Driving. Included within the 50 hours must be 10 hours in moderate to heavy traffic and 15 hours of night driving.

    • Road Test.The vehicle used in the road test must be safe, insured and registered, and it must be driven to and from the testing facility by a licensed driver. The road test evaluates the applicant s skills in each of the following areas:
      • Steering
      • Acceleration
      • Braking
      • Clutch/Gears
      • Speed
      • Communication
      • Observation
      • Traffic signs, signals and markings
      • Following distance
      • Stopping position
      • Lane selection and position
      • Anticipation and reaction
    • Pay a License Fee. Each applicant is required to pay licensing fees after completing the testing requirements. These fees range from $64.25 to $107.50 depending on the type of license and endorsements. A full list of fees can be found at DMV.NY.gov.
    • If under 18 years of age, the applicant must wait 6 months from the date the learner s permit was released to schedule a road test.

    DUI/DWI Laws

    • BAC limit: .08 The New York DMV website has published a document providing all the necessary information regarding New York DUI/DWI laws. Following is a summary of New York s relevant DUI/DWI violations. While aggravated DUI (BAC of .18 or higher) holds more severe penalties and Driving While Ability Impaired (BAC .05 to .07) holds less severe penalties, DWI (BAC .08) is included here to provide an average example.
    • First Offense:
      • Misdemeanor
      • Minimum $500 and maximum $1,000 fine.
      • Maximum 1 year imprisonment.
      • Age 21 and older receives a minimum 6 month license revocation, and under 21 receives a minimum 1 year license revocation.
    • Second Offense within 10 Years:
      • Class E Felony
      • Minimum $1,000 and maximum $5,000 fine.
      • Maximum 4 years imprisonment.

    5 best and worst states for car insurance costs

    The summer driving season is fast approaching, which is great news if you’re planning a road trip. But summer is also the busiest season when it comes to auto insurance claims, so now might be a good time to make sure that your coverage is up to date. According to the National Association of Insurance Commissioners (NAIC), the average annual cost of car insurance nationwide was $815 in 2012.

    At the same time, insurance premiums fluctuate widely by state, due to factors such as rural vs. urban drivers, percentage of uninsured drivers, local cost-of-living figures and hazardous weather conditions.

    To get a closer look at state-by-state insurance costs, InsuranceQuotes.com has just issued a report measuring average premiums using information from the largest insurance carriers in each state. It also created an “average” driver: someone who is employed and who drives a 2012 sedan, has a bachelor’s degree, an excellent credit score and no lapse in insurance coverage.

    Most expensive: #5 Louisiana

    Insurance premiums for drivers residing in the Bayou State are 33 percent above the national average. Much of Louisiana is rural, which means lower crime rates, fewer cars, less congestion and fewer accidents. But Mike Barry, a spokesman with the nonprofit Insurance Information Institute, pointed out that the state ranks high when to comes to natural disasters like hurricanes, which can damage vehicles through flooding, falling trees or debris thrown by high winds.

    Most expensive: #4 Delaware

    Delaware residents have auto insurance premiums that cost 41 percent above the national average. CarInsurance.com points out that he state has low liability requirements for personal, bodily injury and property damage insurance. It’s also near the bottom of the national list when it comes to auto thefts by state.

    But Delaware has a relatively dense population. It’s also in close proximity to two of the worst cities in the nation when it comes to auto crash rates: Washington, D.C., and Baltimore, Maryland — which might also play a factor.

    Most expensive: #3 New York

    The Empire State’s auto insurance premium rates are 42 percent above the national average. The metro New York City region has some of the highest population densities in the nation, so it’s no surprise it also has high rates of auto theft and collisions. Residents of New York City’s borough of Brooklyn have the second-highest car insurance premiums in the nation (Detroit is first). In fact, residents of one particular Brooklyn ZIP code pay 151 percent more than the average premium payment elsewhere in the state.

    But some other factors may be at play. The Insurance Information Institute’s Mike Barry said Metro New York is still dealing with the aftermath of Superstorm Sandy in 2012, “and the claims made on flooded vehicles could still be affecting prices today.”

    Most expensive: #2 Rhode Island

    It may be the smallest state, but Rhode Island has some of the biggest auto insurance premium costs in the nation. They’re 45 percent above the national average. The state capital of Providence is one of the top cities in the nation when it comes to auto collision rates. And about 15 percent of the cars on Rhode Island’s roads are uninsured, driving up rates for people who do have insurance.

    Most expensive: #1 Michigan

    What’s up with Michigan? The average annual cost for an auto insurance policy in the state is an astounding 136 percent above the national average.

    According to InsuranceQuotes.com, a couple of factors are involved.

    “Michigan is the only state where car insurance includes unlimited lifetime personal injury protection, so that’s a major reason why car insurance is so expensive in Michigan,” Laura Adams, the company’s senior analyst, said in a press statement.

    “Since younger people are injured more frequently in auto accidents than older drivers, the cost of covering a lifetime of medical expenses could easily climb into the millions-of-dollars range,” added Lori Conarton, communications director for the Insurance Institute of Michigan.

    Another issue is the unusually high number of Michigan drivers without insurance. InsuranceQuotes.com said some estimates say around half of the drivers in Wayne County, where Detroit is located, don’t have auto insurance. No surprise, then, that coverage in Wayne County costs 45 percent more than Michigan’s statewide average.

    Least expensive: #5 Wisconsin

    Being a mostly rural state means fewer cars and less traffic, and that has helped Wisconsin keep its auto insurance costs 28 percent below the national average. While rates in the state’s biggest city, Milwaukee, are the state’s most expensive and nearly twice what most Wisconsin drivers pay, the state capital of Madison is one of the best cities in the country when it comes to low auto collision rates.

    Least expensive: #4 Maine

    Maine’s relatively small and mostly rural population allows auto insurers to keep costs 33 percent below the national average

    “We have few large urban areas so we have lower overall traffic problems, and we don’t have hailstorms or tornadoes,” Jeffrey McDonnell, president of the Maine Insurance Agents Association, recently told Insure.com. McDonnell also noted that Maine has one of the highest rates of insured drivers in the U.S., “so we have more people sharing the risk.”

    Maine was recently listed as the least expensive state when it came to insuring 2015 editions of the top 20 best-selling vehicles. The state also has one of the lowest motor vehicle theft rates in the U.S.

    Least expensive: #3 Ohio

    Being a partially rural state is just one factor that has helped keep Ohio auto insurance rates 33 percent below the national average. But intense competition among the state’s insurance companies is certainly another. Insure.com, quoting state data, says over 670 auto insurance carriers do business in the state, which is second only to Illinois.

    “Ohio continues to be a strong advocate for its citizens and has a strong insurance department that stays on the forefront as times are changing,” Jeannine Giesler, president of the Professional Independent Agents Association of Ohio, told the website. “It’s possible to get from independent agents rates that are very competitive.”

    Least Expensive #2: Idaho

    With its car insurance rates 37 percent below the national average, Idaho has the least expensive car insurance in the Western U.S. A recent Insure.com study said the average premium in Idaho is about half of what a driver would pay in Montana and several hundred dollars lower than the average rate in Oregon.

    Being a mostly rural state certainly keeps down those auto insurance rates. However, Insure.com also noted that only about 7 percent of Idaho drivers are uninsured, compared to the national average of around 13 percent.

    Least expensive: #1 North Carolina

    Leading the list with the least expensive car insurance in the nation, North Carolina has premium costs 41 percent below the national average. The Tar Heel State has some obvious advantages.

    As InsuranceQuotes.com points out, it’s mostly rural. But as North Carolina’s insurance commissioner says on the state’s Department of Insurance website, the state also “sets a cap on car insurance rates, and insurance companies compete by offering discounts below the established cap.”

    In fact, the competition to sell insurance for the lowest auto premiums is intense. According to InsuranceQuotes, North Carolina insurers offer more than 2,000 different types of auto insurance discounts, “an uncharacteristically high number.”

    Passenger Injury Claims After a Car Accident

    A passenger who gets hurt in a car accident usually has an easier case than a driver or any other type of personal injury plaintiff. This is because the passenger does not have to worry about proving liability; one of the drivers is going to be liable.

    As with any personal injury claim, in a car accident case the plaintiff must be able to prove two things: liability (the defendant’s fault) and damages (how badly the plaintiff was injured).

    If the accident was a two car accident, one of the drivers is definitely going to be liable. It is almost impossible to have a two car accident without at least one of the drivers being deemed negligent in some way.

    If the accident was a one car accident (i.e. the driver hits a tree), then the driver will usually be liable. As a general rule, if the driver hits something, he/she typically did something (or failed to do something) that amounts to negligence. But there are always exceptions. One exception could be if a driver hits a deer that suddenly jumps out of the bushes and bounds across the road. No one expects to have a deer jumping into his/her way. It is certainly possible for a driver to be found not negligent in that situation.

    Filing a Passenger Injury Claim

    A passenger injury claim proceeds just like any other type of car accident claim, except that the passenger would make the claim against both drivers, if it was a two car accident.

    The passenger would want to get the insurance information for each driver, and file claims with each driver’s insurance company. But there are exceptions again. If, for example, one of the drivers was obviously not negligent, like if he/she was rear ended, the passenger in that car would not generally bother filing a personal injury claim against the driver of the lead car.

    If the accident took place in a no fault state, the passenger would file a Personal Injury Protection (PIP) or No Fault claim against that driver with respect to his/her medical bills and lost earnings.

    After the passenger has completed his/her medical treatment, the case is now ready to be settled. If it is a case where both drivers could be at fault, the passenger or a lawyer has to negotiate with both drivers’ insurance companies. In many cases, a passenger injury claim can be settled painlessly, but there are situations where it is difficult to settle passenger injury cases.

    Two Car Accident Passenger Injury Case — Neither Side Wants to Settle

    Let’s take an example of a two car accident in which both drivers are at fault.

    Let’s say that one passenger is injured and has a claim worth about $100,000. If the case goes to trial, and the jury finds both drivers equally at fault, each driver’s insurer will have to pay $50,000 to the injured passenger. But if the jury assesses liability at 75/25, then of course one driver’s insurer will have to pay $75,000, and the other driver’s insurer will only have to pay $25,000. Sometimes, innocent passengers can get caught in a dispute between the two insurers over which driver is more liable.

    Let’s say that insurer #1 believes that its driver is only 25% at fault, but insurer #2 believes that its driver is only 25% at fault. That means that each insurer is only going to be willing to pay $25,000 toward the settlement. The passenger is now stuck. In order to get the full value on his/her case, the passenger will have to wait until one or the other insurer caves and agrees to pay the proper amount, which is a waste as far as the passenger is concerned. So, in this example, you can see how a fight over liability between the two insurance companies unnecessarily delays the passenger’s settlement.

    Multiple Passenger Injury Claims

    Another potential problem in passenger injury cases is when there are multiple passengers.

    Let’s say that a car with three passengers is rear ended, and all four occupants of the car are injured. All four people file claims against the negligent driver. If the total value of the injury cases exceeds the driver’s insurance, each injured person will have to settle with the negligent driver for less than what his/her case is worth.

    Basically, all of the injured people have to take their money from the same small pot. If the injured people can’t agree with each other as to how much each should get, the insurer is usually not going to settle with any of them. The passengers are then going to have to file suit in order to settle the issue of how much each of them will get.

    Example: You finance $30,000 for a new car. The second you drive it off the lot, it could only be worth $25,000. If your car is totaled, you’re still responsible for the $30,000 on the loan. Add this and we’ll pay $25,000 for your car + the $5,000 left on your loan.

    The state of New York sets minimum levels of automobile insurance coverage that every driver must buy to comply with the law.

    To be in compliance with the law, if you live in New York, you must buy the following levels of auto insurance:

    • Bodily injury liability insurance – $25,000 for bodily injury to one person; $50,000 for bodily injury to all persons.
    • Property damage liability insurance – $10,000 for property damage in any one accident.

    In addition, mandatory “no-fault” coverage of $50,000 is required.

    You can carry higher liability limits and additional personal injury protection and most motorists do.

    Insurance rates will vary depending on where in the state you live. Generally, rates are higher in New York City.

    The insurance coverage you buy must be obtained from a company that is licensed by the New York State Department of Financial Services. Out-of-state insurance is not acceptable.

    Driver education reduces premiums

    You may be able to reduce your auto insurance premiums by completing a state approved six-hour driver’s education course.

    If you are the principal driver of a motor vehicle, you will receive a minimum 10 percent reduction in the base rate of your automobile and motorcycle liability and collision insurance premiums each year for three years after completing the course. You can take the course in the classroom or online.

    Getting caught without insurance costly

    If the DMV learns you were involved in an accident and do not have auto insurance, you could lose your driver license and vehicle registration for at least one year. You could also lose your license and registration for at least one year if someone else driving your uninsured vehicle is involved in a traffic accident and is found to be operating without insurance.

    New York – like many other states – has adopted a graduated driver’s license program. You can apply for a learner’s permit when you turn 16 with a parent’s consent.

    To get your junior driver’s license, you will need to hold your learner’s permit for at least six months. During that time, you must:

    • Get at least 50 hours of driving experience, including 15 hours of driving after sunset
    • Or complete a driver’s education course or a pre-licensing safe driving course

    Once you are eligible and you pass the road test, you will be granted your junior’s license.

    A junior license comes with restrictions depending on where you live in the state. For example, if you live upstate, you will be allowed to drive after 9 p.m. for school or work but not if you live in New York City.

    When you’re 17 and if you have a certificate from a driver’s education course, you can upgrade to a standard license. Your license will automatically upgrade when you turn 18.

    If you hold a junior license and are driving, you may have only one passenger in your car who is not a family member.

    Also, no driver, no matter what age, is allowed to text or use a portable electronic device while driving in New York.

    Keeping track of teen drivers

    If you are parents or guardians of drivers younger than 18 years old, you can be automatically notified by mail should your child receive a traffic conviction, be involved in a reportable accident, or have his license suspended. You can enroll your child in the Teen Electronic Event Notification Service (TEENS) online.

    New to New York

    If you move to New York, you must apply for a New York State driver’s license within 30 days of becoming a New York state resident. You can exchange an out-of-state driver’s license as long as it has:

    • Your photograph
    • Has not been suspended or revoked
    • Has been valid for at least six months

Increasing your insurance from the state minimum to full coverage with a $500 deductible costs, on average, $947 more, or $79 a month. For just $67 a year you can raise your liability limits.

    Drivers who buy the cheapest car insurance in New York may be taking a big gamble. If you get into an accident, your assets are at risk if you have basic car insurance. Even a minor incident can cost much more than what your minimal insurance will pay out. For instance, say you have New York s minimum of $25,000 in bodily injury coverage and $10,000 in property damage. Then you cause a crash that totals the other driver s car, valued at $25,000. It also results in $45,000 of medical expenses for his injuries. You re responsible for damages not covered by insurance. Comprehensive insurance pays to replace stolen cars and for damages from vandalism, flooding, hail, fire and animal strikes. New York drivers pay an average of $355 a year for collision and $156 for comprehensive.If your car is:

    • less than 10 years old, you should strongly consider buying collision and comprehensive.
    • more than 10 years old, only buy collision and comprehensive if your car is worth $3,000 or more, if you couldn t afford to replace your car if it s wrecked, or if you just want more protection on your policy.

    Uninsured/underinsured motorist

    These coverages are required in New York and should match the liability limits you choose. Uninsured motorist coverage and underinsured motorist coverage pays for damages if you re hit by a driver with no insurance or a driver with coverage that s insufficient to pay for your repairs and medical expenses.

    Medical coverage (MedPay)

    Medical payments coverage can help pay for the medical or funeral expenses of covered drivers and passengers after an accident, regardless of fault, up to $25,000. MedPay is optional in New York and not a must-have coverage, because your PIP protection takes care of the same expenses as MedPay. However, one benefit of MedPay is that there is no deductible and it can help defray health insurance costs. MedPay does the following:

    • Covers you and your passengers medical expenses
    • Pays for expenses after health insurance limits are exceeded
    • Offers additional protection to insured drivers who are hit by a car while walking or biking

    If you and your passengers:

    • Don t have health insurance, or have a plan that doesn t cover car accidents or has low limits, we recommend that you add medical coverage of at least $5,000 to your car insurance policy.
    • Do have health insurance, it s still a good idea to have medical coverage if you want the best protection in your policy, as it can pay out after your health benefits are maxed out.

    Gap insurance

    If you don t own your car outright and have an accident, gap insurance pays the difference between the cash value of your car and the current outstanding balance on your loan or lease.

    • If you re financing your car, your car is less than one year old and you ve put less than 20 percent down on it, you should buy gap insurance. If not, you don t need gap insurance.
    • If you re leasing your car, it s a good idea to buy gap insurance if you aren t already required to in your lease agreement.
    • If you own your car outright, you don t need gap insurance.
