The Denver County Sheriff’s Department staffs and maintains two detention facilities in the City and County of Denver. The two facilities have an average daily inmate population in excess of 2,000.

Medical treatment information

Doctors in California’s workers’ compensation system are required to provide evidence-based medical treatment. That means they must choose treatments scientifically proven to cure or relieve work-related injuries and illnesses. Those treatments are laid out in a set of guidelines that provide details on which treatments are effective for certain injuries, as well as how often the treatment should be given (frequency), the extent of the treatment (intensity), and for how long (duration), among other things.

To comply with the evidence-based medical treatment requirement, the state of California has adopted a medical treatment utilization schedule (MTUS). The MTUS includes specific body regions guidelines adopted from the American College of Occupational and Environmental Medicine’s (ACOEM) Practice Guidelines, plus guidelines for acupuncture, chronic pain, and therapy after surgery. The Division of Workers’ Compensation also has a committee that continuously evaluates new medical evidence about treatments and incorporates that evidence into its guidelines.

Additionally, employers are required to have a program called utilization review (UR). UR was implemented as a way to confirm the treating physician’s plan for the injured worker is medically sound. To ensure prompt and effective medical treatment is provided to injured workers, UR must be completed within strict timelines. Claims administrators who don’t meet the timelines or the criteria for a proper UR program are subject to audits and penalties. Injured workers, attorneys, medical providers or others who find that UR is not being done according to the regulations can file a complaint with the DWC.

Disability ratings

Most workers fully recover from job injuries but some continue to have medical problems. Permanent disability (PD) is any lasting disability an injured employee experiences, which results in reduced earning capacity after maximum medical improvement is reached. Life Insurance Resource Center

Agent – An insurance company representative licensed by the state who solicits and negotiates contracts of insurance, and provides service to the policyholder for the insurer. An agent can be independent agent who represents at least two insurance companies or a direct writer who represents and sells policies for one company only.

Annuity – A contract that provides a periodic income at regular intervals, usually for life.

Annuity Certain – A contract that provides an income for a specified number of years, regardless of life or death.

Application – A statement of information made by a person applying for life insurance. It helps the life insurance company assess the acceptability of risk. Statement made in the application are used to decide on an applicant’s underwriting classification and premium rates.

Beneficiary – The person named in the policy to receive the insurance proceeds at the death of the insured. Anyone can be named as a beneficiary.

Bonus Rate Annuity – An extra percent of interest credited to an annuity during the first year that it is in force. The extra amount is above the interest rate to be credited beginning the second year and the remaining years that the annuity is in force. The extra rate is paid in the first year in an effort to attract new policyholders.

Cash Surrender Value – The amount available in cash upon voluntary termination of a policy by its owner before it becomes payable by death or maturity. The amount is the cash value stated in the policy minus a surrender charge and any outstanding loans and any interest thereon.

Direct Response – Insurance sold directly to the insured by an insurance company through its own employees by mail or over the counter.

Disclosure Statement – A comparison form required by New York Department of Financial Services Regulations to be given to every applicant considering replacing one life insurance policy with another.

Dividend – A return of part of the premium on participating insurance to reflect the difference between the premium charged and the combination of actual mortality, expense and investment experience. Dividends are not considered to be taxable distributions because they are interpreted as a refund of a portion of the premium paid.

Evidence of Insurability – A statement or proof of your health, finances or job, which helps the insurer decide if you are an acceptable risk for life insurance.

Expense – Your policy’s share of the company’s operating costs-fees for medical examinations and inspection reports, underwriting, printing costs, commissions, advertising, agency expenses, premium taxes, salaries, rent, etc. Such costs are important in determining dividends and premium rates.

Face Amount – The amount stated on the face of the policy that will be paid in case of death or at the maturity of the policy. It does not include additional amounts payable under accidental death or other special provisions, or acquired through the application of policy dividends.

Free Look Provision – A certain amount of time provided (usually between 10-30 days) to an insured in order to examine the insurance policy and if not satisfied, to return it to the company for a full refund.

Insurable Interest – For persons related by blood, a substantial interest established through love and affection, and for all other persons, a lawful and substantial economic interest in having the life of the insured continue. An insurable interest is required when purchasing life insurance on another person.

Lapse Rate – The rate at which life insurance policies terminate because of failure to pay the premiums. When policies are lapsed before enough premium payments are made to cover early policy expenses, the company must make up this loss from remaining policyholders. Therefore, the lapse rate will affect the cost of the policy.

Life Expectancy – The probability of an individual living to a certain age according to a particular mortality table. This is the beginning point in calculating the pure cost of life insurance and annuities and is reflected in the basic premium.

Misstatement of Age – The falsification of the applicant’s birth date on the application for insurance. When discovered, the coverage will be adjusted to reflect the correct age according to the premium paid in.

Mortality – The incidence of death at each attained age; frequency of death.

Non-Forfeiture – One of the choices available if the policy owner discontinues premium payments on a policy with a cash value. Options available are to take the cash value in cash or to use it to purchase extended term insurance or reduced paid-up insurance.

Non-Participating – A life insurance policy in which the company does not distribute to policyowners any part of its surplus.

Participating Policy – A life insurance policy under which the company agrees to distribute to policyowners the part of its surplus that its Board of Directors determines is not needed at the end of the business year. The distribution serves to reduce the premium the policyowners had paid.

Policy – The printed legal document stating the terms of insurance contract that is issued to the policyowner by the company.

Policy Proceeds – The amount actually paid on a life insurance policy at death or when the policyowner receives payment at surrender or maturity.

Policyowner – The person who owns a life insurance policy. This is usually the insured person, but it may also be a relative of the insured, a partnership or a corporation.

Premium – The payment, or one of the periodic payments, a policyowner agrees to make for an insurance policy. Depending on the terms of the policy, the premium may be paid in one payment or a series of regular payments, e.g., annually, semi-annually, quarterly or monthly. The premium charged reflects the expectation of loss, expenses and profit contingencies.

Rating – The basis for an additional charge to the standard premium because the person insured is classified as a greater than normal risk usually resulting from impaired health or a hazardous occupation.

Reduced Paid-up Insurance – A form of insurance available as a non-forfeiture option. It provides for continuation of the original insurance plan, but for a reduced amount, without further premiums.

Reinstatement – Restoring a lapsed policy to its original premium paying status, upon payment by the policy owner, with interest, of all unpaid premiums and policy loans, and presentation of satisfactory evidence of insurability by the insured.

Rider – An endorsement to an insurance policy that modifies clauses and provisions of the policy, including or excluding coverage.

Risk Classification – The process by which a company decides how its premium rates for life insurance should differ according to the risk characteristics of individuals insured (e.g., age, occupation, sex, state of health) and then applies the resulting rules to individual applications.

Settlement Options – The several ways, other than immediate payment in cash, in which a policyholder or beneficiary may choose to have policy benefits paid. These options typically include the following:

  • Interest Option – death benefit left on deposit at interest with the insurance company with earnings paid to the beneficiary annually.
  • Fixed Amount Option – death benefit paid in a series of fixed amount installments until the proceeds and interest earned terminate.
  • Fixed Period Option – death benefit left on deposit with the insurance company with the death benefit plus interest paid out in equal payments for the period of time selected.
  • Life Income Option – death benefit plus interest paid through a life annuity. Income continues under a straight life income option for as long as the beneficiary lives or whether or not the beneficiary lives, under a life income with period certain option.

Standard Risk – The classification of a person applying for a life insurance policy who fits the physical, occupational and other standards on which the normal premium rates are based.

Substandard Risk – The classification of a person applying for a life insurance policy who does not meet the requirements set for the standard risk. An additional premium is charged on substandard risks to provide for the probability that such a person will have a shorter life span than a standard risk.

Supplementary Contract – An agreement between a life insurance company and a policyowner or beneficiary in which the company retains at least part of the cash sum payable under an insurance policy and makes payment in accordance with the settlement option chosen.

Underwriter – The person who reviews the application for insurance and decides if the applicant is acceptable and at what premium rate.

Underwriting – The process by which a life insurance company determines whether it can accept an application for life insurance, and if so, on what basis so that the proper premium is charged.

About California’s Low Cost Automobile Insurance Program

California Law requires that all drivers of vehicles within the State maintain evidence of financial responsibility. California’s Low Cost Automobile Program (CLCA) was established by the Legislature in 1999 and exists pursuant to California Insurance Code Section 11629.7 as a program designed to provide income eligible persons with liability insurance protection at affordable rates as a way to meet California’s financial responsibility laws.

Tomorrow, if everything goes well, I will buy a used car from an individual in California. Here s a checklist of things for that, to help others in similar situations. Some things may have already been omitted because they weren t relevant for me, so you may want to independently browse the websites I m using as sources. I m skipping everything related to finances and haggling. I m not covering cases where the car isn t in good condition. Also, buying from dealerships is different. Good luck.

Find an ad on craigslist or whatever. I liked http://losangeles.listpic.com/car/

Call the seller. Don t just email, start evaluating the seller. Things to ask: http://www.carbuyingtips.com/questions.html (though that list is horribly extensive; I d rather just pick the three best-looking candidates and do that thing on the spot; you ll need to doublecheck anyway to make sure the seller wasn t lying).

Ask for:

  • the VIN of the car (usually 17 characters, on windshield)
  • full name of the seller (you ll need it anyway for the check)
  • Check the CARFAX report for the car. Go for the $24.95 30-day option, you should always look at more than one car.

    • compare odometer, accident history etc with what seller said (better yet, just avoid accident cars, the risk isn t worth it)
    • make sure it s not an old junk car poorly repaired ( salvage title)
  • Check the smog check history (fails are a sign of trouble). In California, in most of the cases, the seller is required to provide a certificate of check newer than 90 days old — it seems the information flow to website is slow enough that this latest check does not show up, or something.

    Check that the car hasn t suffered storm damage. (Annoying website demands cookies for a simple form. Suck.)

    Make an appointment and go see the car. In good sunlight, you want to see the car.

    • you have to drive the car; leave a photocopy of your drivers license if needed for assurance
    • bring a car nut friend who knows what to check; play good cop bad cop (this checklist is not as good, as I am not a car nut)

    • cracked windows
    • accident damage
    • signs of water damage
    • tires
    • check the VIN you were given against windshield, doors, engine, dashboard, major body parts; if they don t match you are dealing with a criminal
  • while driving:

    • brake hard, is it even
    • rev the engine, does it sound healthy
    • make plenty of starts and stops
    • go through a manual gearbox, there should be no grinding noises
    • see if the car will drive straight with your hands off the wheel
    • how does the clutch feel?
    • listen for noises throughout the test drive
  • after driving:

    to be really careful, you should check a lot of things like

    Take the car to a mechanic of your choosing for evaluation. Alternatively, choose to trust on service from brand name vendor.

    Check the price against Kelley Blue Book etc.

    Now you re in business. Only bureaucracy and doublechecking left.

    If you know what you re willing to pay, go to your bank and get a cashiers check. Or two alternatives, if that works out. Otherwise, you will need to go back to the bank after haggling, and without a deposit the seller may have sold the car to someone else. Or something. Tuff.

    (Some people say haggling at dealerships is easier if you show up with a cashiers check just a bit short from what they re asking.)

    Don t pay with cash, there s even less chance of getting it back than cancelling a check.

    If you happen to be a seller reading this, do the actual sale in a bank to be sure you aren t being cheated.

    California Solar Initiative Rebates

    California Solar Initiative rebates vary according to utility territory, system size, customer class, and performance and installation factors. The rebates automatically decline in “steps” based on the volume of solar megawatts (MWs) with confirmed project reservations within each utility service territory. The figure below shows the expected schedule for rebate decline over time. To find the currently applicable rebate level in your area, check with your local utility administrator. There are two incentive paths available to consumers: Expected Performance Based Buydown and Performance Based Incentive.

    The CSI Program pays solar consumers an incentive based on system performance. The incentives are either an upfront lump-sum payment based on expected performance, or a monthly payment based on actual performance over five years. The Expected Performance-Based Buydown (EPBB) is the upfront incentive available only for smaller systems. The EPBB incentive is a capacity-based incentive that is adjusted based on expected system performance calculated using an EPBB calculator that considers major design characteristics of the system, such as panel type, installation tilt, shading, orientation, and solar insolation available by location. The EPBB calculator estimates the expected performance of a solar system based various factors including the tilt, azimuth, location, PV module type and mounting type of a specific system.

    The Performance Based Incentive (PBI) is paid based on actual performance over the course of five years. The PBI is paid on a fixed dollar per kilowatt-hour ($/kWh) of generation basis and is the required incentive type for systems greater than 30 kW in size, although smaller systems may opt to be paid based on PBI. In the beginning of the CSI Program, all systems 100kW and greater were required to take the PBI incentive. In January 2008, all systems 50kW and greater were required to take the PBI incentive. As of January 2010, all systems 30kW and greater are required to take the PBI incentive.

    These two incentive types are explained in more detail in the table below.

    As an English major I have learned to appreciate the peaceful, yet exhilarating moment when my mind engages with an author’s thoughts on a page. As Toni Morrison says in The Dancing Mind. “[reading is] to experience one’s own mind dancing with another’s.” In my early days as a college student, I wanted to know the “true” meaning of a work or what the author intended, however, I have now realized this would void literature of its most noteworthy complexities. Individual interpretations bring varied insights to a work and it is also interesting to point out messages the author may not have realized s/he included in the piece.

    I have always been a thinker, but throughout my coursework, I have greatly sharpened my critical analysis skills. Instead of focusing on proposed meanings or biographical background, I have learned to continuously ask “why” on many different levels. I challenge myself to dig into a text as deeply as possible and unpack every detail to develop a satisfying close read. Also, by reading multiple novels by the same author I have learned to identify different writing styles and make connections that weave texts together; this helped me develop a deeper understanding of the novels. When I look at one of my freshman level novels and see clean pages, I realize that I did not actively read the book. I guess you could say that I have learned to read with a pen, which has drastically taken my writing to a new level because I am able to connect back with my initial insights marked on the page.

    Writing had always been one of my strengths, but it was challenging to take that initial step past the high school, five-paragraph essay form that constricted my ideas for so long. Moving past this form, however, has greatly opened my mind. My thoughts are now able to be more complex because I have learned how to sustain a logical argument in an organized manner. My writing has become increasingly more concise and I no longer have room for added “fluff” or “padding.” Another improvement is my ability to point out multiple complexities within a text, instead of sticking to one-sided arguments in my papers. Furthermore, learning how to find peer reviewed journal articles and order books through interlibrary loan has significantly widened the scope of my research, which has lead to more scholarly papers with credible references. My writing is so much more interesting than it used to be.

    It is difficult to identify gaps in my knowledge as an English major, only because I feel like I have learned so much. I feel that I have largely expanded my literary analysis and writing skills, but I need to be prepared to teach high school students their required literature. I think it would be useful to identify commonly taught novels in our local high schools and study them myself. By studying the required literature and thinking about how to teach it, I will have a sturdy foundation to work from once I am in the classroom.

    A Pasadena man was named Friday in a seven-count indictment that charges him with committing a series of bank robberies culminating in an armed robbery in which he allegedly used a loaded shotgun.

    Shownee Shon Smith, 41, was charged robbing a Wells Fargo Bank branch in East Pasadena on June 10 while armed with a loaded shotgun.

    The Pasadena Police Department responded to alarms and a 911 call from inside the Wells Fargo branch and arrested Smith immediately after he exited the bank.

    The indictment alleges that Smith committed six bank robberies between May 15 and June 10. In addition to the Wells Fargo robbery, Smith is charged with robbing branches of US Bank in Burbank on May 15, Wells Fargo in South Pasadena on the same day, Chase Bank in East Pasadena on May 20, Chase in North Hollywood on May 27, and Citibank in Tarzana on the same day.

    Prior to the Wells Fargo robbery on June 10, Smith had allegedly used notes to demand money from bank employees.
    Smith is additionally charged with brandishing a firearm during the June 10 robbery.

    An indictment contains allegations that a defendant has committed a crime. Every defendant is presumed to be innocent until and unless proven guilty in court.

    Smith, who is being held in custody without bond, is scheduled to be arraigned on the indictment on July 5 in United States District Court.

    The five bank robbery charges in the indictment carry a statutory maximum sentence of 20 years in federal prison, and the armed bank robbery count carries a maximum sentence of 25 years. If convicted of the count alleging brandishing of a firearm, Smith would face a mandatory seven-year sentence that would run consecutively to any other sentence imposed in the case.

    The case against Smith is the result of an investigation by the FBI, which received substantial assistance from the Pasadena Police Department, the South Pasadena Police Department, the Burbank Police Department, the Los Angeles Police Department and the Santa Monica Police Department.

    The case is being prosecuted by Assistant United States Attorney A. Carley Palmer of the General Crimes Section.

    Reading Specialist Certificate

    Classes begin Fall, Spring and Summer

    The U.S. Bureau of Labor Statistics predicts that those who specialize in the development of reading curricula will see a projected employment increase of 22% through 2016. This jump in the number of reading specialist jobs reflects the need to meet new high standards in education.

    Our reading specialist certificate program is accredited by the National Council for Accreditation of Teacher Education. Completion of this program will prepare you to sit for the NTE (National Teacher Examination) reading certification exam. NTE certification will provide you with reading certification for grades K-12 in Pennsylvania.

    The program was designed to prepare students in the classroom with technics to strengthen instructional skills and theoretical orientation. It also prepares students for the role of a reading specialist, who serves as a reading specialist resource to the school district.

    The reading specialist exam and Praxis must be taken by all students in this program. Applications for the reading specialist exam are available in the College of Education and Human Services Office. For more information, read the Graduate Program Reading Guide .

    California Medical Cannabis Retailer Licensing Rules

    This post is on California s initial rules governing medical cannabis retailers as part of our ongoing series analyzing California s initial medical cannabis rules pursuant to the Medical Cannabis Regulation and Safety Act ( MCRSA ). For information regarding the licensing rules for California cannabis manufacturers and cultivators, go here and here .

    The MCRSA defines dispensary as a facility where medical cannabis, medical cannabis products, or devices for the use of medical cannabis or medical cannabis products are offered, either individually or in any combination, for retail sale, including an establishment that delivers, pursuant to express authorization by local ordinance, medical cannabis and medical cannabis products as part of a retail sale. There are two kinds of dispensary licenses under the MCRSA: Type 10 for a general dispensary and Type 10A, defined as just a dispensary.

    The MCRSA restricts vertical integration of cannabis licenses by limiting applicants to one or two licenses in certain separate licensing categories (Governor Brown s Trailer Bill will change this if it passes this summer). A Type 10 licensee can only be a retailer and until January 1, 2026, a Type 10A licensee can be a retailer at no more than three retail locations by holding three separate Type 10 licenses: that of a manufacturer and a cultivator (so long as the Type 10A license has no more than four acres of total canopy size of cultivation throughout the state).

    In addition to the mandatory submissions for owners and their spouses we discuss here. California cannabis retailers must also submit a complete list of every individual with a non-controlling interest in the retailer, though there are no indications non-controlling interest holders will be vetted by the state in the same way owners will be.

    Retail applicants must submit all of the following to the State of California as well:

    1. A list of funds belonging to the retailer held in savings, checking, or other accounts maintained by a financial institution.
    2. A list of investments made into the retailer entity.
    3. A list of all gifts of any kind given to the retailer for its use in conducting commercial cannabis activity.
    4. Whether an owner or their spouse has a financial interest in any other cannabis license. Financial interest” means an investment into a commercial cannabis business, a loan provided to a commercial cannabis business, or any other equity interest in a commercial cannabis business.
    5. A list of all convictions (excepting juvenile crimes and traffic infractions under $300 that didn t involve alcohol, controlled substances, or dangerous drugs) as well as a rehabilitation list for each conviction.
    6. Application for fingerprints through the Department of Justice.
    7. Documentation issued by the local jurisdiction in which the applicant proposes to operate certifying the applicant is in compliance with all local ordinances and regulations, or will be in compliance with all local ordinances and regulations by the time the Bureau issues a license.
    8. Evidence that the proposed dispensary location is at least a 600-foot radius from any school. In addition, the retail premises must be in a contiguous area and may only be occupied by one licensee, and retailers cannot sublet any portion of the retail premises.
    9. If you have 20 or more employees, an attestation that the applicant has entered into a labor peace agreement and you must provide a copy of that agreement.
    10. A $5,000 surety bond.
    11. A scaled diagram of the dispensary premises that shows the boundaries of the property and the proposed premises to be licensed, showing all boundaries, dimensions, entrances and exits, interior partitions, walls, rooms, windows, doorways, and common or shared entryways. The diagram must show the areas in which all commercial cannabis activities will take place, including but not limited to, limited-access areas.
    12. A list of your quality assurance, security, and inventory practices.
    13. Proof of acknowledgement from the dispensary property owner that you can use the property for dispensing and a copy of your lease agreement if you have it. Or if you own the property, provide the deed.

    Regarding retailer operational standards, the retailer is responsible for sufficiently tracking and tracing all of its inventory and for record keeping certain records must be kept for at least seven years. The retailer must also follow all security, surveillance (including installation of 24-hour recording cameras of a certain pixellation that covers certain areas of the operation by a specific number of feet), alarm, and premises access requirements. The retailer is also responsible for cannabis waste-management destruction and disposal. And though California cannabis retailers cannot package or label any cannabis goods, they still must provide exit packaging for products, which basically means re-sealable and opaque child resistant packaging. And if a retailer discovers any defective product, it may return the medical cannabis goods only in exchange for a non-defective version of the same medical cannabis goods. So, no cash refunds.

    As far as customers go, between the hours of 6 a.m. to 9 p.m. only verified qualified patients or primary caregivers over 18 can freely shop in the dispensary. Nonetheless, anybody younger than 18 can enter the dispensary to purchase medical cannabis goods if they are a medical cannabis patient accompanied by their parent, legal guardian, or primary caregiver. Customers are free to inspect medical cannabis goods through secured containers, but no sampling is allowed. A customer purchase no more than 8 ounces in a single day, unless their physician s recommendation authorizes more.

    Under the MCRSA, delivery” means the commercial transfer of medical cannabis or medical cannabis products from a dispensary, up to an amount determined by the bureau to a primary caregiver or qualified patient. or a testing laboratory. “Delivery” also includes the use by a dispensary of any technology platform owned and controlled by the dispensary. that enables qualified patients or primary caregivers to arrange for or facilitate the commercial transfer by a licensed dispensary of medical cannabis or medical cannabis products. So long as city or county law allows for delivery, dispensaries must deliver all product themselves; they cannot use a third party contractor or courier to do it. All deliveries must be done in person by a retail employee who s at least 21, and all deliveries have to go to physical addresses in California. When making deliveries, dispensary employees cannot carry more than $3,000-worth of cannabis goods at any time. No delivery can be made to an address on publicly owned land or any address on land or in a building leased by a public agency. Finally, delivery hours are from 6 a.m. to 9 p.m.

    These rules are currently in a 45-day comment period and are by no means final. So, stay tuned to see if and when the Bureau makes additional changes. I am sure these rules seem onerous to many of you, and they are. But for what it is worth, they are in many respects very similar to the laws in various other states where we have helped our clients secure cannabis licenses Oregon, Washington, Colorado, Nevada and Alaska, for instance and so as difficult as they may seem, it is certainly possible to satisfy them.

    How to Choose Medical Malpractice Insurance

    Medical malpractice insurance falls into three categories: claims-made, occurrence and claims-paid coverage. The most common type of policy is claims-made coverage.

    Claims-made policies cover policyholders for alleged acts of malpractice that take place and are reported to the carrier during the policy period. Claims-made policy premiums are relatively low for the first few years due to the fact that there is often a significant lag between when a treatment is administered and the filing of a claim resulting from that treatment. Because of this, claims-made premiums are structured to increase each year that the coverage is in continuous force until the risk presented approximates a mature risk. This is usually in years 5, 6, or 7 for individual physicians.

    As a result, one advantage of claims-made coverage is that premiums are based on actual past and current experience. Policyholders therefore do not pay premiums for future liability that is difficult to project.

    Another advantage of claims-made coverage is that it enables physicians to increase liability limits when necessary. For example, the limits of liability in effect at a policy’s inception may not be enough to cover a settlement incurred today. In this case, the physician may which to increase his or her limits of liability. The most desirable claims-made policies establish the limits of liability available to the policyholder as those in effect at the time a claim is reported rather than those in effect at the time the incident occurred.

    Since claims-made policies only cover claims reported, and arising from, incidents that occurred while that policy is in effect, policyholders must be wary when switching carriers or otherwise terminating coverage. When terminating a claims-made policy with one carrier, physicians should obtain either tail coverage (extended reporting coverage) from their old carrier or retroactive (prior-acts) coverage from their new carrier. Both of these coverages insure against claims reported after the end of the original policy period for incidents that occurred while that policy was in effect.

    When purchasing a claims-made policy, prospective insureds should look for a guaranteed right to purchase tail coverage. They should also verify the length of time that tail coverage will be available since some companies offer tail coverage only for a fixed number of years. Another feature to look for is tail coverage that is provided at no charge upon retirement for permanent and total disability and in the event of death.

    Premiums for tail coverage are determined by a doctor’s specialty, territory, limits of liability and length of continuous claims-made coverage. Tail coverage gets more expensive the further back in time it must provide coverage since the liability assumed by the carrier becomes greater. It is usually a percentage of the insured’s prior years premium.

    Prior Acts ( Nose ) Coverage
    Prior acts coverage provides similar protection as reporting endorsement coverage. However, unlike a tail, nose coverage is purchased through the new insurer.

    An occurrence policy insures for any incident that occurs while the policy is in effect, regardless of when a claim is filed. Under an occurrence policy, insureds pay premiums that take into account not current experience, but future projections as well. Such claims are called incurred but not reported (IBNR). Occurrence insurance rates can vary significantly because of the difficulty in projecting future claims expenses. Under an occurrence policy, the limits of liability are those in effect when the incident occurred.

    The advantage of an occurrence policy is that neither retroactive (prior acts) nor tail coverage is needed when terminating coverage.

    Claims-paid coverage is often used by Trusts. Under a claims-paid policy, premiums are based only on claims settled during the previous year and projected for the current year. Claims-paid policies are generally assessable for a number of years after the policy has been terminated. In addition, claims-paid policies usually have restrictive claims triggers, under which a claim is not considered formally made until a Summons and Complaint is received. As a result, policyholders changing from claims-paid coverage to claims-made coverage might find it difficult to obtain retroactive (prior acts) coverage from the new carrier. Physicians leaving a claims-paid carrier will most likely have to purchase expensive tail coverage from that claims-paid carrier.

    Teachers take on Republicans in gas tax recall fight

    The state’s largest union representing teachers is wading into the political fight to recall state Sen. Josh Newman. D-Fullerton, over his vote earlier this year to raise California gas taxes and vehicle fees to pay for road repairs.

    The 325,000-member California Teachers Association contributed $250,000 to the campaign committee formed to oppose the recall of Newman, according to campaign finance records filed Monday with the Secretary of State’s office.

    Those behind the recall, including Carl DeMaio. a radio talk show host and former San Diego councilman, have reported $44,000 in contributions to the pro-recall campaign committee. The Howard Jarvis Taxpayers Association is also supporting the effort.

    It is circulating the recall petition online at “fireJoshNewman.com” calling on voters to help break Democrats’ supermajority in the Legislature.

    Republicans have long held control of the Southern California district represented by Newman. They see his vote in favor of the Democratic-backed $52-billion road repair package as their chance to take back the seat next year. Though a lone Republican helped the Democrat-dominated Legislature and Gov. Jerry Brown pass the tax increase, organizers targeting Newman are casting him as “the deciding vote” according to the recall petition.

    Meanwhile, Assemblyman Travis Allen. R-Huntington Beach, is seeking to repeal the widely unpopular gas tax increase. Allen reports he and other recall proponents are awaiting approval of the ballot initiative language by the state Attorney General’s office. The California Republican Party has raised tens of thousands of dollars for the 2018 ballot measure, according to state filings.

    The California Teachers Association did not respond to a request for comment. Newman voted in line with the union’s positions in some cases, and voted against them in others, according to its legislative scorecard. For example, Newman supported a state bill from Sen. Anthony Portantino. D-La Cañada Flintridge, that would require middle and high schools to begin no later than 8:30 a.m. – which the union opposed. But he voted in favor of the bid from state Sens. Ricardo Lara, D-Bell Gardens, and Toni Atkins. D-San Diego, to create a publicly funded, government-run health care system for the entire state that teachers endorse.

    CLIMATE CHANGE: Brown is hosting the prime minister of Fiji, Voreqe Bainimarama. in Sacramento today, where he is expected to join the “Under2 Coalition” – a commitment by cities, states and countries to reduce heat-trapping emissions. It’s named for the 2-degree global temperature benchmark at which the consequences of rising Earth temperatures are considered potentially “catastrophic,” as the governor’s office puts it.

    The signing ceremony is set for noon. Oregon Governor Kate Brown and Washington Governor Jay Inslee are expected, as well as state Senate President Pro Tem Kevin de León and Assembly Speaker Anthony Rendon.

    After the Republican chairman of the Senate intelligence committee told Harris to be more “courteous” during her questioning of Deputy Attorney General Rod Rosenstein involving the Trump-Russia investigation, the former California attorney general’s political operation sent an email blast to supporters saying, “no really, that happened.”

    “We believe we need courage, not courtesy, especially with the integrity of our democracy and our government at stake,” she said in the email.

    DOGS IN HOT CARS: With the hottest summer days ahead, the California Highway Patrol at 10:30 today will demonstrate on the East Lawn of the Capitol how to free an animal trapped in a hot car.

    A bill from Assemblyman Marc Steinorth. R-Rancho Cucamonga, signed by Brown last year. made it legal for people to smash the windows of vehicles that are too hot or too cold, as long as there’s no other way to rescue the animal. People are required to first contact law enforcement.

    CALIFORNIA’S TOP COP: Attorney General Xavier Becerra is expected to discuss how he views his role as California’s chief law enforcement officer when it comes to issues like public safety and immigration at an afternoon forum hosted by the Public Policy Institute of California .

    Becerra, appointed by Brown after Harris was elected to the U.S. Senate last year, has been in office just six months. He has promised to fight the Trump administration on immigration, health care and the environment. The conversation with Becerra begins at 12:15 p.m. It’s available for viewing online .

    GOVERNOR’S RACE: The only declared Republican running for governor next year, John Cox, is expected to lay out his political platform at a Sacramento Republican Assembly meeting tonight in Carmichael.

    Cox, who has called for the creation of a “Neighborhood Legislature,” is considered a long-shot in the 2018 race. His popularity fell 9 percentage points in the latest survey from UC Berkeley’s Institute of Governmental Studies. The poll ranked Lt. Gov. Gavin Newsom and former Los Angeles Mayor Antonio Villaraigosa as the two leading candidates.

    The meeting begins at 6 p.m. at the Church on Cypress in Carmichael.

    RALLY FOR MEDI-CAL: Disability rights advocates will lobby for the preservation of Medi-Cal and other proposed laws to help disabled people at a rally set for 9 a.m. at Cesar Chavez Plaza in Sacramento.

    False claims stoke fears about reforming California’s bail system

    Assemblyman Travis Allen and reality TV star “Dog the Bounty Hunter” have a message: California bail reform is a threat to public safety.

    In a recent video, Allen insists, “Senate Bill 10 would eliminate the bail system in California.” He’s wrong. “If it passes, criminals would no longer have to post bail and would be free to roam our neighborhoods.” He’s wrong about that, too. “My good friend Duane ‘Dog’ Chapman joined me at the Capitol to fight SB 10 and protect our communities and keep fugitives where they belong.” Third strike: that’s not why the bail industry is fighting to protect commercial bail.

    Across a growing number of states, industry representatives are working to protect the status quo by making false claims about pretrial release and stoking fear about the consequences of reform.

    First, SB 10 would restructure California’s bail system. but it would not. as industry defenders claim, “eliminate the bail system.” With reform, few defendants would still need to pay a nonrefundable fee to a bond company to get pretrial release. Instead, courts would assess whether individual defendants were flight risks or threats to public safety. Defendants deemed “bad risks” would have to submit to release with conditions, like checking in with a pretrial officer or taking random drug tests.

    Second, bail industry representatives claim reform is dangerous because bail bond companies help protect public safety. That assertion bears little resemblance to my firsthand experience.

    I worked as a bail bond agent in a large urban county for a little over a year for my ethnographic research. During this fieldwork, I heard a great deal about “public safety” from lawyers arguing about bail and judges making pretrial release decisions. But I rarely encountered mentions of public safety in the bail office. So long as defendants could pay us 10 percent of their bail, provide a solid co-signer (and, in some cases, collateral), and convince us they weren’t a major flight risk, we’d bail them out. Once defendants are out, the company’s main concern is protecting its investments – not the public’s safety.

    To quote Allen, a Republican from Huntington Beach, our clients were “free to roam our neighborhoods.” We rarely kept in touch with clients unless they missed court or a payment; our office staff sent email and text reminders to avoid missing court. And we didn’t worry whether they might commit crimes while on release – that was the cops’ concern, not ours. Even if the police arrested someone we’d bailed out, our investment was protected: Defendants who are locked up don’t miss court.

    When pressed, industry representatives will insist that bail companies protect public safety by returning fugitives to justice. And yes, some defendants fail to appear for their court date, and recovery agents usually track them down. But our bail company typically waited days or weeks after receiving forfeiture notices before sending out a bounty hunter or otherwise spending money on fugitive recovery. Often, before any expenditure was needed, the police arrested our clients or defendants turned themselves into the local jail. No need to open our wallet and send out our own cavalry.

    The connection between commercial fugitive recovery and public safety, then, is truly tenuous. Even if we assume defendants roam the streets committing crimes as they await trial, that’s hardly a justification for cash bail. It would be at least as effective – though less profitable – to strengthen police departments’ capacities to track down fugitives.

    The bail lobby’s “tough on crime” campaign paints a misleading portrait of commercial bail. Their fight against SB 10 is not about protecting public safety. It’s about protecting a lucrative industry.

    Driving While Distracted Can End in Trouble

    In his seven years as a California Highway Patrol officer, Joseph Pace has seen drivers do some pretty dumb things behind the wheel. But perhaps the stupidest act was performed by a motorist driving 75 mph last summer on the Glenn Anderson Freeway in South Los Angeles.

    It’s not that the driver was going 10 mph over the speed limit. It’s that he was doing it while watching a soccer match on a portable television set he held in one hand. The driver used his other hand to adjust the antenna–it is difficult, after all, to get good reception in a moving car. He used his knees to steer.

    Pace cited him for driving at an unsafe speed for prevailing conditions. “The safe speed for driving with no hands is zero miles per hour,” Pace said.

    While shocking, this type of behavior is nearly an everyday occurrence on the freeways and streets of Southern California, according to CHP officers, truck drivers and other professional motorists.

    Such extracurricular activities behind the wheel range from the mundane (talking on a cell phone), to the bizarre (driving naked) to the death-defying (putting on pantyhose). Many motorists have been caught in the driver’s seat performing tasks that are normally done in a bathroom, such as brushing teeth or putting on makeup. And a few have been cited for performing deeds typically conducted in the bedroom.

    The National Highway Traffic Safety Administration estimates that at least 25% of police-reported crashes involve some form of driver inattention. That number may be higher in Los Angeles, where commuters spend an average of an hour a day in traffic. That’s the equivalent of nearly 11 days a year.

    A recent survey of motorists in 10 of the nation’s largest cities dubbed Los Angeles drivers “masters at multi-tasking behind the wheel.” The survey, by a coalition of steel manufacturers, found that 68% of Los Angeles drivers routinely drink beverages and 59% eat while driving. An additional 15% of drivers apply makeup, shave or comb their hair while navigating L.A.’s treacherous roads, according to the survey.

    “You name it and our officers have encountered it,” said CHP Sgt. Tim Maley, a 25-year veteran.

    There is no violation in the California Vehicle Code for driving while applying makeup. Instead, law enforcement officers typically cite distracted drivers under Section 22350: unsafe speed for prevailing conditions. It is the equivalent of a speeding ticket.

    According to Southern California police agencies, CHP officers and truckers, such dangerous driver deeds fall into the following four categories:

    Hoping to make use of the long hours spent on the road, many commuters perform their morning grooming rituals–shaving with electric razors, brushing teeth and applying makeup–while driving to work. But some take it a step too far.

    CHP Officer Ken Duke said he recently cited a woman for putting on makeup–using the rearview mirror. while reading a newspaper. draped on the steering wheel–and driving on the Pasadena Freeway. “She wasn’t very happy about it,” he said.

    About a year ago, veteran truck driver Margaret Peterson said she was cruising along the Long Beach Freeway about 55 mph when, from her elevated vantage point, she spotted a woman steering a car with her knees while using both hands to try to work her legs into a pair of pantyhose.

    “I have trouble putting on pantyhose in my own home, so I don’t know how she pulled it off,” said a flabbergasted Peterson. “It was unreal.”

    Cell phone use has become common on L.A. streets, but reserve Los Angeles Police Officer Eric Rose said he stopped a speeding motorist who was practically conducting a business meeting from within his Mercedes-Benz on Ventura Boulevard in the San Fernando Valley a few weeks ago.

    The driver, who was holding an e-mail device in one hand, was reading the message on the screen while using the other hand to talk on a cell phone. The steering he left to his knees.

    But that driver might be considered downright cautious compared with the man CHP Officer Brandon Shipwash ran across about a year ago on a downtown Los Angeles street.

    While driving about 30 mph, the motorist was spotted playing a computerized football game on a Sony PlayStation that was built into the car’s console.

    “He was really getting into the game, too,” Shipwash said.

    CHP Sgt. Maley recalls the many years he patrolled the desert freeways near Indio as dull and uneventful–for the most part. He remembers one hot summer night when he was responding to a call of a stranded motorist.

    He stopped a car on a deserted road to ask the occupants if they had seen the ill-fated motorist. When Maley peered into the car, he was surprised to see a young couple wearing nothing but expressions of surprise.

    Maley let them go with just a warning, saying: “This is California, so. “

    • 23152(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle.
    • 2315d(b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle
    • 2315d(e) It is unlawful for a person who is under the influence of any drug to drive a vehicle.
    • 23152(f) It is unlawful for a person who is under the combined influence of any alcoholic beverage and drug to drive a vehicle.

    Note: In most cases, both the 23152(a) and (b) offenses will be charged. Even though there is only one act, the law says that a defendant charged with drinking and driving can be convicted of BOTH offenses but can only be punished for one (the punishments are identical). Vehicle Code section 23153 sets forth the “felony DUI” provisions where an injury results from the drunk driving, while Penal Code sections 191.5 and 192 describe the crime of “vehicular manslaughter” where there is a death.

    Procedurally, you should be aware of certain legal rights you have rights which are commonly ignored by the police:

    • There must be legally sufficient facts to constitute “probable cause” to stop, detain and arrest you.
    • You should be advised that submission to field sobriety testing and portable field breath testing is not required by law.
    • Once arrested, you must be advised of your constitutional rights the “Miranda” warning before any further questioning takes place.
    • You must be given a choice of breath or blood testing ; if you refuse, you must be advised of the legal consequences (the “implied consent” advisement).
    • If a breath test is administered at the police station, since the breath sample is not saved, you must be given a chance to obtain a blood sample for later independent testing by your DUI defense attorney .

    1. Read and follow your owner’s manual.
    2. Select a repair shop before you need one, but be sure it is registered with BAR.
    3. Know your rights as a consumer.
    4. Keep this guide in your car and refer to it before taking your car in for service.

    Your Owner’s Manual

    Your owner’s manual explains what your car’s warning indicators mean and what to do if they come on. Paying attention to those indicators can keep small problems from becoming big ones.

    Besides warning lights, you should also pay attention to how the car performs as you drive each day. Note anything out of the ordinary and deal with it as soon as possible. Most mechanical problems get worse with time.

    Remember that simple and inexpensive procedures like oil changes help your car last longer. Follow the manufacturer’s recommended service schedule for oil changes and other maintenance, including fluid or flush services, to help prevent serious problems. The service schedule is in your owner’s manual.

    Medical Insurance Plans for Families, Individuals and Students

    For those of you who haven’t researched health insurance plans and benefits lately, you could be in for a rude awakening. Plans today include a wide range of benefits but you’ll want to know exactly what the plan covers before you buy. The cost of health insurance can be expensive but there are things you can look for in various products that will give you just the right amount of coverage to maximize your health care dollars.

    Every consumer should not only be looking at the annual deductible, but they should also be looking at the out of pocket maximum (also known as oop). The out of pocket maximum is the maximum amount that you will pay in one calendar year (JAN DEC) if something catastrophic (like hospitalization) happens to you. Some plans out of pocket maximum includes the annual deductible and with some plans, you need to add the annual deductible to the out of pocket maximum in order to determine what your potential out of pocket costs could be if you were to suffer something catastrophic. This is very important to know.

    Review the benefit details and the plan brochure to see how exactly the plan works. If you really want to see the very detailed plan benefits, ask to see the specific plans Evidence of Coverage.

    When researching a plan, look to see if there is a limitation to the number of doctor office visits. Plans that limit the number of office visits are generally less expensive.

    Review the prescription benefits. Most companies utilize a drug formulary list. Depending upon how the specific drugs are displayed or not displayed on the list determines the price you will pay for those prescription drugs. Note that most brand drugs will be subject to a separate annual brand drug deductible before the brand drug co-payment will apply. Plan brand drug prescription deductibles can be as low as $250 or as high as $7500. Generic drugs are generally not subject to the annual brand drug deductible. Inquire into how your specific prescription drugs will be covered under a plan you are considering. Plans offering a high prescription drug brand deductible or that offer generic only prescription drug coverage tend to be less expensive.

    Research the provider directories. Probably the most important thing to do before you buy a plan is to research the provider directories to make sure the plan you are considering is part of that specific plan’s network. You should also never trust 100% the online directories. Providers are still constantly changing networks. It’s always the best idea to call the provider after researching the directory just to double check that they are contracted with the plan as an in-network provider in stead of an out-of-network provider. Visiting an out of network provider could potentially not be covered at all or you could be subject to significant charges. Be aware that we have found some inconsistancies with some of the provider networks. Some insurance companies claim that their networks are the same if you purchase the plan through Covered CA or if you purchase that same plan off exchange directly from them. We have found that to be not neccessarily so. When talking with your provider be sure to thell them whether you are considering a Covered CA plan or an Off Exchange plan. You will need to tell them the insurance company name whether it’s an HMO or PPO and be sure to tell them whether it’s an individual plan or a group plan (employer sponsored coverage).

    When reviewing other benefits and when you come across a benefit with a percentage (example inpatient hospital 40% or outpatient hospital 40%) it usually represents your share of costs after you have satisfied the plans annual deductible. After your annual deductible, you will be billed at this percentage (based on a negotiated rate) until you reach the plans out of pocket maximum. Once the out of pocket is met, most of the services are covered at 100% for the duration of that calendar year.

    One last thought. We are in the midst of health care reform. Insurance Plans are subject to change any time in order to remain compliant with health care reform laws. It pays to ask questions and compare your plan benefits every year. You’ll be glad you did.
