This years birthday was all about the color pink and princesses. My oldest is obsessed, (to say the least) with princesses, and she had been asking for a princess party for months. So I did my best to create any princesses dream party I may have gone overboard and next year s party will probably be at chuckie-cheese

    5 Lessons From T-Mobile s Game-Changing Strategy

    Typical mobile industry players are regarded as arrogant and insensitive to the frustrations of the consumers. It’s an industry that has long frustrated customers with complex plans, locked-in contracts, restrictions against upgrading phones and the loss of investments in existing devices. But now, T-Mobile has introduced a game-changing marketing strategy to the market.

    They call themselves the Un-carrier, to vividly emphasize that they are doing something radically different. They’re basing their whole philosophy around doing exactly what the customers want, as indicated by their feedback. It sounds simple. So why did it take so long to create such a strategy? And why was T-Mobile, the number 4 player in the industry, the first to innovate? (Full Disclosure—Prophet was a partner with T-Mobile in developing the new strategy.)

    A Brief History of T-Mobile’s “Un-carrier” Marketing Strategy

    The “Simple Choice Plan,” introduced in March of 2013, included elements that broke long-time industry practices. Long-term contracts were replaced with monthly plans with no long-term commitment. Plan pricing that required you to estimate minutes used and text messages sent was replaced with plan pricing that was much more flexible and easier to understand. The basic plan includes unlimited talk, text and web access (up to 500MB high-speed) and can be augmented for those that need large pools of high-speed data. Finally, you can bring your own device to the program. You don’t have to buy a new phone, but if you do, T-Mobile will finance it over 24 months. When it’s paid off, the monthly bill will be reduced accordingly.

    With Un-carrier 2.0, launched in the summer of 2013, family plans without necessary credit checks were added. This was a huge deal for users that are routinely slammed with multiple $200 deposits on family plans. Families could now get four lines with unlimited talk, text, and web (up to 500MB high-speed) for $100 per month, plus taxes and fees. In addition, the JUMP! (Just Upgrade My Phone) Program recently launched, where a person who subscribes for $10 a month can update their phone twice a year. At the same time improvements in their network, particularly in major urban areas, were announced, improvements that allowed T-Mobile to surpass Sprint on coverage.

    And the momentum continues. In October of 2013, T-Mobile announced at a New Your concert event their Un-carrier 3.0 strategy, by which they would deliver unlimited global data at no extra charge in 100+ countries. The program was a dramatic attack at the practice of charging large fees for cross-border connection.

    Then, at the 2014 Consumer Electronics Show (CES), T-Mobile announced an offer to pay the termination fee of the locked-in customers of Verizon, Sprint or AT T and give them a credit toward a new phone. The colorful T-Mobile CEO, John Legere was quoted as saying, “We are either going to take over this whole industry or these bastards are going to change.”

    The Impact of T-Mobile’s “Un-carrier” Campaign

    Since the Un-carrier launch, T-Mobile has steadily brought this strategy to life through positioning, framing the discussion, messaging, communications, customer experience and employee engagement. The strategy was supported by humorous advertising (advertising gets easy when you have something to say) that featured Bill Hader as an inept phone-user who welcomed the Jump! program. The JUMP! campaign was led by some outrageous (think Steve Jobs-style) presentations by Legere talking about why customers are switching to T-Mobile and how backward competitors are.

    At the beginning of 2013, T-Mobile was suffering from an ongoing loss of share that affected its image as well as its financial health. The Un-carrier initiative dramatically changed that. At one point during the campaign, T-Mobile was gaining customers at a rate that exceeded the three competitors combined. Further, according to a study by Baird Equity. 26 percent of potential wireless carrier switchers are looking at T-Mobile, as compared to 9 percent for Sprint, 10 percent for AT T, and 19 percent for Verizon. In the minds of many, T-Mobile went from an also-ran company to a firm with leadership position that reinvented a major industry. It’s an amazing achievement.

    5 Lessons to Learn from the T-Mobile’s Marketing Strategy

    As I discussed in Brand Relevance . the only way to grow is to create “must haves” that define a new subcategory.

    T-Mobile was not able to grow until it did just that, developing a half dozen “must haves.” Note that the disruption was not caused by a technological advance, but by some simple changes in pricing and contracts.

  • A new subcategory needs to be protected.

    T-Mobile protected its innovative, disrupter position with breakthrough brand-building and ongoing game-changing innovation.

  • The disruption was driven by an understanding of basic customer frustrations and complaints.

    In fact, it did not take strategic insight that was subtle and nuanced. Perhaps the depth and influence of these customer issues were underestimated, but they were well known.

  • Any brand can become a true challenger brand.

    It is interesting that the brand that pulled off this innovation wasn’t Verizon or AT T, but the fourth place player. Why was that? The industry leaders had too much to gain by sticking with the status quo. As a challenger brand, T-Mobile had less to lose and more to gain by disrupting the wireless category and doing what the other carriers do not; they put the customers’ needs ahead of business-as-usual.

  • Once you start innovating, keep up the momentum.

    All three major competitors scrambled to respond with their own versions of fewer contracts, quicker upgrades, cheaper plans and more. To maintain relevance, they had no choice. But they are all clearly copying the innovator, playing catch up. Although these competitors have an impressive set of assets, it is likely that the market structure will be changed by the T-Mobile initiatives. Further, the T-Mobile momentum and energy will make it hard to reverse these changes.

  • Final Thoughts

    The disruption of a major industry doesn’t happen very often. But when it does, there will be significant growth almost always from a new entrant or an also-ran. The essence of strategy in dynamic times is to drive a disruption, understand it and maintain relevance in the new marketplace.

    If you would like to keep your IRA with Millennium Trust, please complete the online Account Agreement. At this time you can update personal information, add funds and obtain online account access.

    There are four easy ways to add funds to your Millennium Trust IRA – IRA Transfers, IRA Indirect and Direct Rollovers, and Contributions.

    IRA transfers are the most common funding method for a new or existing IRA. A transfer is the movement of IRA assets directly from one trustee or IRA custodian to another. In IRAs, these types of transfers are unlimited since funds are transferred from one institution to another. The transaction is not reported to the IRS as a distribution.

    IRA Indirect Rollovers (60-day Rollovers)

    A rollover begins with a distribution from a retirement or qualified plan, followed by a re-contribution of all, or a portion of, the assets to another retirement or qualified plan. The rollover transaction must be completed within a 60-day period or the assets’ eligibility to be returned to a tax-advantaged account is lost. The distribution will then be taxed as ordinary income in the year it was received, and if the individual that received the distribution is under age 59½, the IRS will impose a 10% penalty on the distribution, subject to certain exceptions. It is important for retirement plan owners to take extra precaution that the transaction is completed on a timely basis, as all transactions are reported to the IRS. If the IRS does not receive confirmation of re-contribution within the 60-day period, it will assume the transaction is a distribution, and, therefore, taxable. In some cases, rollovers are not permitted, including the following:

    • IRA owners may not complete more than one rollover within a 12-month period regardless of how many IRAs they own;
    • Rollovers from a SIMPLE IRA plan to a Traditional IRA during the first two years of a SIMPLE IRA’s plan participation;
    • After age 70½, IRA or qualified plan rollover amounts that represent a taxpayer’s required minimum distribution for that year; and,
    • Rollover from a Roth IRA to a Traditional IRA or qualified plan.

    Unlike an indirect rollover, a “direct” rollover always originates with assets in a qualified plan or IRA and involves movement to an IRA or another employer’s qualified plan. At no time are the assets cashable or negotiable by the taxpayer. Also, while direct rollovers are reported to the IRS as distributions, a special code on the distribution report indicates the funds were transferred in a direct rollover to an IRA or employer plan and are, therefore, not taxable. We encourage IRA owners to consult with a tax advisor regarding these limitations before initiating a transaction.

    IRAs are available to anyone who receives taxable compensation. For IRA contribution purposes, compensation includes wages, salaries, fees, tips, bonuses, commissions, taxable alimony and separate maintenance payments. Married couples are each eligible to have an IRA, even if one spouse is not working. One spouse’s annual contribution is limited to the lesser of total taxable compensation or to the yearly amount shown in the following tables. Participants age 50 or older may make an additional “catch-up” IRA contribution in the amounts indicated in the tables below.

    There are no minimum or required IRA contribution amounts, and all earnings on the amounts in a Traditional IRA are not taxed until withdrawn. In the case of Roth IRAs, withdrawals may be made on a tax-free basis provided certain conditions are met.

    How do I erase my hard drive?

    There are many reasons why you might want to clean your hard drive. Simple house-keeping is the most obvious, because a clean hard drive means better performance all round. Personal security also counts when you decide to get rid of your PC – either for sale or scrap. There are also times when you’ve accidentally downloaded something you wish you hadn’t, and need to get rid of it.

    A different level of cleaning may be appropriate for different jobs. But first, you need to have some idea of how your PC usually stores data. The following advice applies to most common operating systems.

    Information is stored in files, and files are made up of fixed-length blocks of data. A large document may contain several hundred such blocks. As you create new documents, your PC fills up its hard drive, grabbing blocks as it goes. When it is new, a file will be made up of blocks sitting neatly next to one another.

    As you use your PC, and start deleting old files and creating new ones, the route between the blocks that make up your files will start to resemble a tangled mess of string.

    ’Defrag’ often

    That’s why the quickest and simplest way to tidy up your hard drive – and often to improve performance – is to ’defrag’ your PC. The defragmentation process (likely to be found somewhere in your system tools) untangles the mess. Any blocks that can be rearranged are shuffled around, until documents are (as far as possible) made up of continuous data clusters once more.

    There is no magic to this. Just remember to turn off other programs before starting – and allow several hours for the process to run.

    The second important consequence of data storage is that your PC keeps tabs on which blocks make up a given document. This is done by something called a file allocation table (FAT). When you delete a file, it isn’t actually deleted. Instead, the FAT is amended so that the blocks that make up a particular document are marked as available for use – but their content remains unchanged.


    Delete in Windows, and the document goes first to the recycle bin, from which it can be restored at the click of a button. Remove it from the recycle bin – or even reformat your hard drive (a process not for the faint-hearted) – and the data is still there, and capable of being recovered by advanced PC tools.

    …then really delete

    If you really, really want to get rid of files or confidential data, you need to invest in a specialised security tool. Look for “complete deletion” or “secure deletion”. Such packages go through your hard drive and systematically overwrite every single unallocated byte of data with a zero – not once, but a dozen or more times.

    After that, unbelievably, the data is still not completely gone, but anything deleted by these means is unlikely to be recoverable, unless it’s by MI5 or the CIA!

    You might be surprised how close you are to a Bachelor s Degree. UMA has established a partnership with the Maine Community College System (MCCS), so that most MCCS graduates are more than halfway to earning their Bachelor s of Applied Science Degree.

    In the BAS program, you will focus on a specific knowledge area by choosing an 18-credit minor with a minimum of 6 credits of upper (300-400) level courses. Click here for a list of UMA minors:

    NOTE: Minors that are under 18-credits and/or do not have a minimum of 6-credits of upper level courses will not meet the BAS degree requirements.

    Along with your program focus, you will also broaden your liberal arts background with courses in English, communications, social and natural science, humanities, fine arts, and mathematics.

    It is anticipated that the MCCS s Associate of Applied Science graduate will transfer approximately 60 credits, including 19-21 credits of general education requirements and a maximum of 39-41 credits of technical/trade courses. The 39-41 technical/trade credits would constitute the Applied Science Major without being named in the degree.

    The general education/core courses from the MCCS will, in most instances, include: college writing, speech or technical writing, social science, lab science, mathematics, and humanities. UMA s 37 credit hour baccalaureate core and general education requirement would need to be met in order to earn the Bachelor of Applied Science Degree. This requirement consists of:


    • Written Communication (6 credits) ENG101 and 3 credits from ENG102W, or 317W
    • Writing Intensive Course (3 credits)
    • Oral Communication (3 credits)
    • Mathematics (3 credits) MAT100 or higher

    There are dozens of players looking to be the go-to storage provider in the cloud, and two of the biggest names are Dropbox and Google. When considering Dropbox vs. Google Drive for your organization, compare the pros and cons of each for enterprise use.

    Dropbox has been the king of the hill since the early days and now has 100 million users who save 1 billion files every day. It offers up to 18 GB of free storage to anyone and has inexpensive paid options for up to 500 GB of storage. Dropbox Pro and Dropbox for Teams accounts offer even more storage and control options for IT administrators. Dropbox maintains version control of documents and has easy options to share files or folders.

    Google Drive is a relative newcomer, but it isn’t just a storage service. It also includes what used to be called Google Docs. The integration of these Software as a Service (SaaS) productivity applications and Gmail lets Google offer a complete service for anyone who wants to store, share and collaborate on files. Drive offers 5 GB of free storage space with paid options that offer as much as 16 TB for a single account. Sharing is very easy, especially if users have contacts set up in Gmail. Using drop-down menus that are similar to the sharing mechanisms on Google Plus, Drive subscribers can set ownership (either Owned by me or Not owned by me ), collaborators and visibility.

    The problem is that Google’s platform can be a one-way street. If you live with Microsoft Office and users need to keep files intact, then you can kiss the Google Docs integration goodbye. Docs can import Word and Excel files, but it will not put them back to their original format if users edit in Docs. Switching back and forth between Docs and Office and dealing with the font incompatibilities and complex styles of the Microsoft Office suite could drive employees crazy.

    On the other hand, if ease of use is what you’re looking for, Docs is a good storage option for your company. Google continues to add more integration across its products as well. Google supports 10 GB attachments from Gmail using Drive, plus website publishing straight from Drive.

    Dropbox’s file-sharing core competency remains a dominant draw for many who still attach files to locally running applications. Dropbox also maintains a healthy third-party compatibility. which makes it popular as a storage utility for many Web and mobile apps. Browser add-ons such as Dropbox Folder Sync, the JotForm Web front end for file upload via a website, and the ability to request files easily with FileStork are examples of Dropbox’s easy-access application program interfaces (APIs).

    That’s not to say Google is devoid of third-party options, but the APIs are only available to Web apps published to the Chrome Store. Popular Web options such as SlideRocket can use Drive, but the integration is limited to specific use cases.

    Both services offer Web access via a browser, plus a full complement of clients. The desktop clients for Windows and Macintosh integrate directly with your file system, which synchronizes files to and from your local hard drive. They both also have easy-to-use mobile apps. Google Drive is available for Android and Apple iOS (with iPhone and iPad-specific versions) and Dropbox covers Android, iOS and BlackBerry. Drive lets users make files local for offline availability and Dropbox offers users the ability to auto-upload photos from a mobile device.

    Dropbox vs. Google Drive security

    One major concern of any cloud service is security. and file services are often a vector for hacking. Dropbox has been a victim of attack, most notably in 2011 when a Dropbox change caused any account to become accessible using any password. This hole was open for 4 hours, and although the issue was closed fairly quickly, the incident brought to light the fact that Dropbox, not the client, held security encryption keys.

    In another incident, a hacker gained a list of user email addresses via a hacked Dropbox employee account. No other Dropbox accounts were hacked, but the users on that email list became victims of email spamming. Dropbox reset every user’s password and enabled a new two-factor authentication. The service, launched in August 2012, texts users a code that they must enter in addition to their password. Instead of the text option, Dropbox subscribers can use a time-based, one-time password generator, such as Google Authenticator or Amazon Web Services’ Multi-Factor Authentication apps to generate the code.

    There haven’t been reports of hacks for Google Drive, but Drive uses a central Google account that employees likely use for Gmail, Google Plus and other Google services, which makes Drive an easy hacking target. Gmail accounts get hacked because people use weak passwords or they use the same password across sites tied to the email account. Google Drive subscribers can use Google Authenticator for two-factor authentication as well.

    Both providers offer business-specific versions. Google has Google Docs for Business, which includes all the features of Drive but allows teams using the same email domain to easily share documents and collaborate. Dropbox has a group version called Dropbox for Teams that gives you more control with Active Directory integration, access control for links and easy device security management.

    Both services have strong but different feature strengths. If you’ll be moving toward a Google world with Docs and Gmail, heavy Chrome OS and/or Android use, then Drive is a contender for your cloud storage. If yours is a more heterogeneous computer environment where you still use plenty of local applications and don’t want to rely on one-way Docs integration, then you’ll see Dropbox as a better fit. Just remember to take every security option the service you choose offers.

    Platform as a Service (PaaS) is a cloud model designed for software developers that streamlines the development process by shifting specific aspects of systems management to the service provider. PaaS is used to develop web and mobile applications using components that are pre-configured and maintained by the service provider, including programming languages, application servers and databases.

    When evaluating and choosing a PaaS provider, you should take into consideration the programming languages and server side technologies the vendor offers along with the data storage options. Support for developer tools and applications integration is also very important as you need to consider how your application in the PaaS will integrate with other applications. Finally, consider the costs of running your applications in a PaaS and evaluate how the pricing model of the vendor you choose works.

    We help you get started by summarizing these key considerations of several PaaS providers. Although this is not a comprehensive list, the vendors represent a sample of the different types of PaaS offerings that are available today. OpenShift automates system administration tasks such as virtual server provisioning, configuration and scaling and supports git repositories for code management.

    Google App Engine uses a sandbox model which isolates processes thereby reducing the risk that a rogue process on a physical server will disrupt operations of other processes on that server.

    Tara Treatment Center provides a holistic approach to substance abuse treatment, promoting mental, physical and spiritual health. Combining 12-Step programs with evidence-based therapy, Tara offers treatment services such as detoxification, residential programs, outpatient care, anger management, individual and group counseling, and relapse prevention and coping strategies to encourage lifelong recovery.

    Addiction recovery does not end with discharge after completing a rehab program. Facilities that offer aftercare planning and/or support work with patients to ensure sustainable recovery by helping to plan and make arrangements for transitional or sober living, help with housing, vocational counseling, etc.

    Patients who undergo intensive outpatient treatment continue to live at home and sometimes go to school or work while participating in a highly structured treatment protocol that is focused on ending substance abuse.     Situated on 13 acres of idyllic countryside just south of Indianapolis, Ind. since its founding in 1985, Tara Treatment Center offers 12-step treatment for adults struggling with addiction. This nonprofit facility offers a variety of services including on-site detox, gender-specific residential treatment, transitional residential treatment, standard outpatient treatment, intensive outpatient care, partial hospitalization, and aftercare. There is also a free service designed for friends and family members seeking a better understanding of addiction and recovery.

    According to the facility’s website, Tara adopts a spiritually-based, holistic approach to treatment. In addition to individual therapy, psychoeducation, and group counseling, Tara offers its clients recovery-specific yoga classes, experiential therapy, relapse prevention education, and equine-assisted therapy.

    Most residential clients remain on-site for four to six weeks. During that time, guests can receive mail and watch TV during designated periods. No outside reading material is permitted. Phone privileges are granted on a tiered system, and visitation is allowed every other Saturday (guests must attend the family education program before visiting a loved one).

    Transitional residential treatment is available for residential clients who require further stabilization and support before returning home. Individuals who are better matched to outpatient care may choose from standard outpatient treatment, intensive outpatient treatment, and partial hospitalization. Aftercare groups meet once a week.

    According to the facility’s website, Tara offers a staff-to-client ratio of 1:5. The center’s multidisciplinary staff is comprised of medical doctors, psychologists, licensed social workers, addiction counselors, and several licensed, master’s level counselors. The clinical director has a Ph.D.

    Tara Treatment Center’s online photo gallery displays fully-furnished sitting rooms and libraries, cheerful eat-in kitchens, and sun-drenched outdoor spaces dotted with gazebos and picnic tables. Sleeping quarters are shared.

    Of eight alumni polled by to date, all offered mostly praise for Tara Treatment Center. The staff’s level of training and expertise received five-star ratings from five alumni and an average four stars from three other alumni, and alumni characterized staff as “supportive” and “caring.” Alum A.P. wrote: “Great place, everyone who works there loves their jobs!”

    The connectivity and visitor policy received four- and five-star ratings from five alumni and an average 3.3 stars from three other alumni as well. Yet a few alumni wrote that the facility’s highly advertised holistic treatments were lacking and that there was not enough individual counseling.

    Alumni appreciated the family programming (receiving a 4.7-star average from three alumni), but one respondent felt that visitation was too limited (a concern echoed by some loved ones polled by Alum Asia wrote: “I didn t like the fact we could barley talk to our families while there and that visits were so short.”

    When asked, on a scale from one to five if they’d recommend Tara Treatment Center, five loved ones polled at the time of this writing rated the facility an average four out of five stars. “Overall nice experience,” one anonymous loved one wrote. Loved ones were impressed with the facility’s cleanliness, its family participation, and the staff’s level of training and experience, which received respective ratings of 4.6, 4.2, and 3.8 stars. “Offering family interaction and outings…Very family oriented place for woman in recovery,” Brenda wrote.

    The center’s exercise and leisure options received an above average rating of 3.5 out of five stars, but the program’s holistic offerings received the lowest rating of 2.8 stars. Additionally, some respondents felt that they didn’t have enough contact with their loved ones and staff during treatment. “We agreed upon Tara as they promised help for not just the addict, but our family. However, no such help was found.They acted as if it the patient was a prisoner and not a patient,” M.W. wrote.

    Tara Treatment Center is in network with several private insurance providers. Both Healthgrove and Citehealth report the facility accepts access to recovery vouchers as well. Eight reviewers polled by rated the program’s affordability an average rating of 4.1 out of five stars.

    Frequently Asked Questions

    Who Can Sue And Be Sued?
    Any individual, business, partnership, or corporation (with a couple of exceptions) may bring a small claims suit against any other individual, business, partnership, or corporation for recovery of money only for an amount up to $5,000. In general, the claim must be filed in the district court of the county in which the defendant(s) reside. Exceptions and specific rules can be found at RCW 3.66.040. The State of Washington may not be sued in Small Claims Court. Unless a judge grants permission, Attorneys and paralegals are excluded from appearing or participating with the plaintiff or defendant in a small claims suit.

    How Much Does It Cost?
    You must pay the court clerk a filing fee at the time the suit is filed. The filing fee ranges between $14 to $29 depending on whether the county you file the lawsuit in supports a dispute resolution center. You may have some additional fees payable to the sheriff or process server to have the Notice of Small Claims served on the defendant. As an alternative, you may serve notice on the defendant by registered or certified, return receipt mailing. If you win your case, you are entitled to recover your costs of filing and service fees.

    How Do I Get Started?
    Contact your local district court; contact information may be located in your local phone book or at First you will prepare a Notice of Small Claim form that is provided by the clerk. You are required to sign the Notice in the presence of the clerk, unless otherwise instructed by the court. On the Notice form a hearing date, trial date, or response date will be entered by the clerk. It is the plaintiff’s responsibility to accurately identify the defendant, provide a proper address and, if possible, provide a phone number.

    How Long Do I Have To File My Case?
    Time limits range from one (1) to ten (10) years. See Chapter 4.16 RCW to determine which time limit applies to your type of case.

    Serving the Notice
    The clerk will assist you with forms and general information about the process. The clerk is not allowed to give legal advice. Service of the claim form can be accomplished by any of the following:

    1. The Sheriff’s Office;
    2. A process server;
    3. Any person of legal age (18) who is not connected with the case either as a witness or as a party; or
    4. By mailing the copies to the defendant by registered or certified mail with a return receipt requested.

    The Notice of Small Claim must be served on the defendant not less than ten (10) days before the first hearing. A return of service, or mail return receipt bearing the defendant’s signature, must be filed at or before the time of the first hearing. You cannot personally serve the claim. See RCW Chapters 4.28 and 12.40, and CRLJ 5 for more detailed information.

    What If We Settle?
    In most cases, neither party is one hundred percent right or wrong. You are encouraged to try to settle your case before trial. If you settle the dispute before the hearing, you must inform the court so the hearing can be canceled and your case dismissed. If the other party agrees to pay at a later date, you may ask the court for a continuance. If the other party pays before the postponed date, ask the court to cancel the hearing. If you do not receive your money by the time of the continued hearing, proceed with the case in court. If you drop the suit, your filing fee and service costs are not returned.

    How Do I Collect My Money?
    A money judgment in your favor does not necessarily mean that the money will be paid. The Small Claims Court does not collect the judgment for you. If no appeal is taken and the judgment is not paid within 30 days, or the time set by the court in the payment plan, you may request (in writing) and upon payment of a $20 fee, that a transcript of the judgment be entered into the civil docket of the court. At that time you may proceed with a method of collection such as garnishment of wages, bank accounts, and other monies of the defendant or an execution may be issued on cars, boats, or other personal property of the judgment debtor. Remember, the clerks cannot give you legal advice. You may need the assistance of an attorney or collection agency at this point. In the alternative, you may take your transcript of the judgment and file it in superior court for a fee of $20. Other fees may be required by the superior court clerkor county auditor. When this is done, it places a lien against all real estate in the name of the judgment debtor that is located in the county.

    When the judgment has been paid in full you must send written notice to the district court that the judgment has been satisfied.

    Can You Appeal A Case If You Lose?
    The party who files a claim or counterclaim cannot appeal unless the amount claimed exceeds $1,000. No party may appeal a judgment where the amount claimed is less than $250. If an appeal is taken to the superior court, the appealing party is required to follow the procedures set out in Revised Code of Washington (RCW) 12.36. The following steps must be taken within 30 days of the entry of judgment:

    1. Prepare a written Notice of Appeal and file it with the district court.
    2. Serve a copy of that Notice on the other parties, and file acknowledgement or affidavit of service in district court.
    3. Pay to the district court a $20 transcript fee.
    4. Deposit at the district court the $200 superior court filing fee either in cash, money order, or cashier’s check payable to the Clerk of the Superior Court and pay a $40 appeal preparation processing fee to the district court.
    5. Post a bond in a sum equal to twice the amount of the judgment and costs, or twice the amount in controversy, whichever is greater, (cash or surety) at the district court.

    When the appeal and bond are transferred to superior court, the appellant (person appealing the decision) may request that the superior court suspend enforcement of the judgment until after the appeal is heard.

    Within 14 days of filing the Notice of Appeal, the district court clerk will transmit the court record to the superior court clerk who will assign a new number and notify the district court. The district court clerk will advise the appellant of that number, and the appellant must then contact the superior court for further instructions.

    Once the judgment has been appealed to the superior court, then enforcement of any judgments entered in the case will be handled in superior court in the same manner as any other superior court judgment.

    Property Damage Liability Insurance: What It Covers How Much to Buy

    Property damage liability coverage helps pay for damage to someone else’s car or other property due to an accident you caused, up to the policy’s limits. It will also cover damage you may cause to structures and stationary objects, including houses, stores, offices, trees, fences, guardrails, lamp posts, telephone poles, and more.

    Property damage liability insurance does not cover damage to your own car. To repair that damage, you will need the physical damage coverage of your collision and comprehensive policies.

    Property damage coverage is one of two types of liability auto insurance. The other, bodily injury liability insurance. covers injuries to the other driver and any passengers. Some minimum amount of both types of liability car insurance is typically required by states.

    We’ll discuss exactly how property damage liability insurance works, what it costs, and how much you need below.

    How It Works

    Liability insurance packages come in two varieties: combined single limit policies and split limit policies. In a combined single limit policy, your policy will offer a certain amount of coverage, and you can decide how to divide that coverage between bodily injury and property damage.

    When it comes to split limit policies, however, your insurance company will decide how much it will pay out for each type of liability coverage. You will often see such policy packages described using a numeric shorthand like this:

    25,000/50,000/20,000 or 25/50/20

    While the first two numbers apply to bodily injury coverage, we’ll focus on the last, which applies to property damage coverage. In this example, this policy would pay up to $20,000 to repair damage to others’ property in an accident you caused. Let’s look at two scenarios.

    Scenario 1: Minor damage. Let’s say you swerved to avoid a squirrel, hop the curb, and hit a neighbor’s fence, causing $5,000 in damage. Your policy would completely cover the cost to repair or replace the fence.

    Scenario 2: Major damage. Let’s say you are driving on the highway when you lose control of your car and hit two vehicles, causing $5,000 damage to one car and totaling another car worth $20,000. Your policy would pay up to $20,000, but you would be responsible for the remaining $5,000 in damage.

    How Much Is Required?

    Most states require drivers to carry a minimum amount of bodily injury and property damage liability insurance. Your state’s minimum property damage liability coverage amount is provided in the map and table below.

    Note that some states give you the option to forgo car insurance if you have enough assets to “self insure.” In these states, you may have to deposit significant funds that could be used if you caused an accident, or post a bond. If you—like the vast majority of drivers—opt not to “self insure,” then you are required to meet at least the minimums above.

    How Much Does It Cost?

    Most state requirements are relatively low, and property damage costs can easily exceed those limits. While the Insurance Research Council found that the average property damage liability claim was just over $3,000 in 2012, you could easily exceed the minimum required coverage if you damage or total a new, expensive car in an accident. The average new car costs over $30,000 today, according to Keep in mind that if the damages exceed your limit that the other party may sue you for the difference, putting your savings and assets at risk.     Cottonwood borer

    The cottonwood borer is a member of the long-horned beetle family, the Cerambycidae. It is the largest member of that family found on the Great Plains and is indeed one of the largest insects found in North America – up to 40mm long and 12mm wide. During the summertime, we often get phone calls from startled people who have found one and are wondering whether the Martians have invaded!

    As adults, and as larvae, these insects depend on the cottonwood for their livelihood. The species will also use willows and poplars, but the cottonwood is the tree it prefers. Like all beetles, the adults have chewing mouthparts. They use their large mandibles to eat the leaf stems and new twigs of the tree while they are active during the summer. After mating, the female will chew small pits near the base of the tree and lay her eggs in them.

    The larvae burrow into the tree and may take two years to mature in cooler climates. Their first year is spent feeding on the roots of the tree and the second burrowing through the heartwood near ground level. They pupate for about 3 weeks during April-June before emerging to complete their life cycle. The puparium is located in a root below ground level. After completing metamorphosis, the adults chew their way out and then dig they way up to the ground surface. Consequently, they don’t leave visible emergence holes on the tree.

    Cottonwood borers are a native species and should not be confused with the Asian longhorned beetle (ALB), a species that has been imported accidentally into the U.S. in the New York City and Chicago areas. Nonetheless, people should know how to recognize the ALB and report it to the local authorities if they find one.

    Two things to look for are:

    The Asian longhorned beetle DOES leave a visible exit hole in the bark of the tree that is about the size of a dime.

    The antennae of the cottonwood borer are solid black while those of the Asian longhorned beetle have white bands on them. The website linked from the image below has comparison photos of these two species as well as several other kinds of insects that might look similar.

    The bold coloration of the cottonwood borer is due not to colors in the exoskeleton, but rather to masses of small white hairs, which are only visible with magnification. The pattern they make is unique to each beetle, like a fingerprint.

    Cottonwood borers are found throughout the eastern U.S. and range as far west as the high plains of southeastern Colorado.

    Viewed head-on, the large mandibles of the cottonwood borer are very visible. They can bite if mis-handled! They may also make a little buzzing/hissing sound when handled.

    Their antennae are about as long as the body, and they have a prominent spine on each side of the thorax.

    If you find one and want to study it, it can be kept for a few days in a small container. Feed it tender new leaves (cottonwood of course!), provide it with a little water, and marvel at this alien in our midst!

    Should you worry if you find them on your property?

    Small cottonwood trees that suffer a large number of the larvae can become sufficiently weakened to break off at ground level in high winds. The adults may also cause malformation of new branches by feeding on the tender new growth. Large trees probably won’t suffer significant harm by them.

    If you have questions about control of these beetles on your property, please read the following. If you have any further questions, I recommend contacting a local garden center, your county extension agent or a pest control agency.

    According to Kansas State Extension Entomology:
    Trees under stress and planted on poor sites suffer attack more often than healthy trees. Therefore, proper site selection, irrigation and fertilization are important steps to reduce injury. Small larvae can be dug out from the base of the trees in early September using a pocket knife.

    Chemical control is based on preventing the adults from laying eggs. Thoroughly spray the lower trunk and saturate the soil around the base of the tree in late June or early July, and again late in July with permethrin. Though there are many homeowner products with permethrin, most do not have a wide borer label. One that does is Hi-Yield Garden, Pet and Livestock Insect Spray.

    What you need to know about Data Center Infrastructure Management (DCIM)

    What exactly is Data Center Infrastructure Management? Is DCIM truly a new idea or just a repackaging of the same old methods?

    Data center airflow management

    The cloud may be here, but it’s not omnipresent nor will it fit the needs of every company. There is still a need for traditional in-house data centers across many kinds of organizations. Even if your company does use the cloud, you might have a hybrid configuration or at least a network and electrical backbone in your facility, which warrants close monitoring and inspection. Of course, you may be a cloud provider yourself, with a supersized data center that warrants the best management solution on the market!

    Data Center Infrastructure Management (DCIM) isn’t a brand new topic; it has been around since at least 2009 and is steadily gaining momentum. 451 Research claimed in April of 2013 that “the growth rate of DCIM far outstrips that for the datacenter equipment industries and for the enterprise IT segment as a whole.” It should be noted, however, that 451 also states DCIM is small by comparison to other elements of enterprise software “such as IT service management, ERP, databases or security.” reported in June of 2013 that: “the growth of cloud services and the datacenters that support [DCIM] could leap from an estimated $450 million this year to $1.7 billion by 2016.” With this much growing potential in store, it’s worth looking at what DCIM can offer.

    Of course, just because something is deemed new doesn’t make it an automatic benefit across the board – nor does it mean the trend or product is really “new.” Thin-client computing is considered by some as merely a reboot of mainframe operations, which have been around for decades. The Apple iPad, launched in 2010, was deemed the first tablet by many who somehow overlooked Microsoft’s Tablet PC ten years earlier. Malcolm Gladwell outlines the amazing transformation of Hush Puppies shoes from stodgy outdated footwear to reinvented fashion craze in his fascinating book, “The Tipping Point.” We live in a society where things get rehashed and revisited and what’s old becomes new again. With that in mind, is DCIM just another re-telling of the same story, like the film “The Amazing Spider-Man” in 2012? In my view, the answer is no.

    What is DCIM?

    It’s safe to say many IT professionals are familiar with traditional methods of infrastructural monitoring such as downtime alerts, server component and/or resource evaluation and network latency checks. Products such as Nagios, WhatsUpGold, Dell IT Assist and Dell Management Console are standard fare when it comes to keeping an eye on the health of your physical systems, software, and environment. DCIM is this, but it’s also more, much like replacing your breakdown-prone Ford Pinto with a finely-tuned Cadillac convertible. It will still get you to the same places but with wider range, power and capability to do new things (like impress your neighbors!).

    How is DCIM different?

    Traditional infrastructural monitoring has been largely about one piece of the jigsaw puzzle, with many other pieces glaringly absent (or for which new technologies showed a need that these products couldn’t fill). For instance ,maybe you can tell your servers are up, but have no way of knowing how many servers you can fit in your space and still safely cool. DCIM fills in those gaps by introducing concepts such as:

    • Asset tracking
    • Change management
    • Analysis of virtual/logical systems and how they interact with physical hardware
    • Management of “utility” operations like electricity, heating and cooling from a usage, efficiency and cost savings perspectives
    • Maximizing system utilization for best efficiency
    • Consolidation of resources/locations
    • Optimizing physical infrastructure (including space management) to enable higher capacity
    • Multi-layered monitoring
    • Future planning via modeling scenarios

    There are plenty of existing software and/or products which handle some of these areas, of course, but the goal of DCIM is to unify them within one centralized point of administration so “the left hand knows what the right is doing” – and so do all the other pieces of the puzzle.

    What are some examples of DCIM in action?

    1. As outlined in a scenario by Gary Bunyan at, a company wants to gain insight into all of their assets including technical (running programs) and financial (serial and asset numbers). DCIM performs this function but, rather than dumping the asset information into an Excel file where it gathers dust, it provides contextual ongoing data about the assets and how they relate to one another to help spot cost cutting opportunities, reduce risk, and better manage the data center. Furthermore, issues such as the impact of the asset on other assets. as well as on the business overall, can be explored.
    2. Emerson Network Powerdiscusses several scenarios of DCIM, one of which involves providing data center technicians “the visibility and control to optimize performance while maintaining or improving availability. With this level of progression, data center management becomes truly proactive as personnel can anticipate potential failures and automatically shift compute and physical resources to eliminate downtime while increasing resource utilization to optimize efficiency across the data center.” Having users page you at 3 AM to report email is down is so 2003.
    3. Yevgeniy Sverdlik of writes that DCIM can keep tabs on “all devices within the IT infrastructure and ongoing health monitoring of each of them as well as monitoring of things like energy consumption, temperature, humidity and airflow. The software uses that data to create a digital model of the infrastructure, updating it as changes occur. The model, ideally presented in an accessible graphical format, is a key aspect of a DCIM solution, as it visualizes interrelationships between devices in the infrastructure. An analytical engine is what interprets the data the solution collects to find problems or inefficiencies.” It’s no longer enough to just monitor the data center to make sure it doesn’t get too hot or check to see if someone left the door open.

    It should be pointed out this this is a field with some growing pains so a magic solution is not a 100 percent universal guarantee. Kevin Fogarty, the author of the Slashdot article referenced above, points out a report from Heavy Reading which indicated vendors need to “adapt their products to manage virtual as well as physical datacenter assets, while scaling their products to accommodate the telco datacenters supporting public cloud services.”

    The Roth IRA Early Withdrawal Penalty

    What’s the Roth IRA early withdrawal penalty?

    Typically, it’s a 10% penalty on investment gains withdrawn from your Roth IRA prior to age 59 ВЅ.

    This means that unless you meet one of the early withdrawal exceptions, your withdrawal must meet two criteria in order to be classified as a qualified distribution which is tax-free and penalty-free.

    What are the two criteria?

    • Reached age 59 ВЅ
    • Funded your Roth IRA for at least 5 years

    You must meet both requirements before you can confidently withdraw funds tax-free and penalty-free from your Roth. Of course, there are exceptions.

    So let’s take a closer look at the rules.

    Roth IRA Distributions After Age 59 ВЅ

    Any distributions of investment gains taken from your Roth IRA prior to age 59 ВЅ are considered early withdrawals.

    Other than the exceptions highlighted below, early withdrawals are subject to income taxes as well as the Roth IRA early withdrawal penalty.

    Notice the phrase “of investment gains.” That’s important.

    Because you need to differentiate between your original Roth IRA contribution and the earnings (investment gains) which result from that contribution.

    Original Roth IRA contributions can be withdrawn at any time tax-free and penalty-free.

    After all, Roth IRA contributions are non-deductible, so you funded your Roth IRA with after-tax funds. Because you’ve already paid income taxes, you shouldn’t have to pay a second tax bill just to gain access to your money.

    But Roth IRA investment gains are a different story.

    Think about it. If you have investment gains in a regular taxable brokerage account, those gains are subject to taxation. And we both know how much the government loves to tax your money.

    So if you make an early withdrawal of investment gains from your Roth IRA, the government is going to want its share.

    So remember, you can withdraw your original Roth IRA contribution at any time tax-free and penalty-free.

    But if you withdraw any Roth IRA investment gains prior to age 59 ВЅ, then you’ll owe income taxes and a 10% Roth IRA early withdrawal penalty on those funds.

    Find that hard to follow?

    Here’s an example.

    At age 25, you open a Roth IRA and contribute $3,000. You never make any additional contributions.

    Fifteen years later, you decide to close the account. It’s now worth $10,000.

    How much of that $10,000 do you get to keep?

    Well, in closing the account early, you don’t owe any taxes or penalties on $3,000 of the $10,000.

    Because you can withdraw your original contribution any time both tax-free and penalty-free.

    But the remaining $7,000 is considered an investment gain. As a result, it’s subject to income taxes and a 10% Roth IRA early withdrawal penalty.

    So assuming a tax rate of 25%, you owe $1,750 in income taxes as well as a $700 early withdrawal penalty. Meaning $2,450 of the $10,000 goes to taxes and penalties.

    That leaves you with a grand total of $7,550 after closing your account.

    An early withdrawal of your original contribution is always.

    Tax-free and penalty-free.

    But an early withdrawal of your investment gains prior to age 59 ВЅ is subject to.

    A 10% Roth IRA early withdrawal penalty as well as applicable income taxes.

    The 5 Year Rule

    Even if you reach age 59 ВЅ, you still need to meet one more requirement before you can withdraw funds tax-free and penalty free.

    And as a general rule, it means your Roth IRA needs to be funded for at least 5 tax years before you can make tax-free and penalty-free withdrawals.

    Need an example?

    Let’s say at age 59 your accountant informs you that it’s a good idea to convert your Traditional IRA to a Roth IRA. You do that in the year 2007, paying the applicable income taxes required by such a conversion.

    The funds continue to grow and in 2010, at age 62, you decide to withdraw those funds.

    Can you do so tax-free and penalty-free?

    Even though you’ve reached and surpassed age 59 ВЅ, you still haven’t met the 5 year rule for that portion of your money which represents the conversion. And you need to meet the 5 year rule before you can withdraw your investment gains tax-free and penalty-free.

    The original contributions can still be withdrawn tax-free and penalty-free.

    But the investment gains need to meet the 5 year rule before they can be withdrawn tax-free and penalty-free.

    In this case, only four tax years have passed. 2007. 2008. 2009. and 2010.

    You meet the requirements of the 5 year rule and are able to withdraw funds in the January following the fifth tax year.

    In this case, 2011 is the fifth tax year. So January 2012 is when you can start to withdraw investment gains both tax-free and penalty-free from you Roth IRA.

    Early Withdrawal Exceptions

    By now we’ve learned that if your Roth IRA meets the 5 year rule and you’ve reached age 59 ВЅ, then you can withdraw funds tax-free and penalty-free.

    But are there other cases when you can withdraw investment gains from your Roth IRA without having to pay taxes and penalties?

    Tax-Free, Penalty-Free Withdrawals

    Tax-free, penalty-free withdrawals are known as qualified distributions, and there are a number of cases where you can take qualified distributions prior to age 59 ВЅ and even before you’ve met the 5 year rule.

    Below are three (3) such instances.

    1) Death – You avoid triggering the Roth IRA early withdrawal penalty if you die and your beneficiary closes your Roth IRA account. Apparently, the IRS finds it highly unlikely you’ll hatch a conspiracy to die in order to avoid paying a 10% penalty. As a result, your beneficiaries can withdraw funds without getting hit with an early withdrawal penalty.

    2) Disability – If you become disabled according to the definition in IRS Code Section 72(m)(7) and IRS Publication 590, then you can take a distribution from your Roth IRA tax-free and penalty-free. However, make sure you consult with a tax attorney or an accountant in order to verify that you meet the government’s definition of “disabled.” You don’t want to get hit with unexpected taxes and penalties!

    3) Purchase of a First Home – If you withdraw funds to pay for the cost of purchasing a first home for yourself, your spouse, your children, and/or your children’s descendants, then you can take a distribution from your Roth IRA without having to pay income taxes or the 10% Roth IRA early withdrawal penalty. However, this is limited to a lifetime total allowance of up to $10,000.

    What does that mean?

    It means you can do this four times for four different family members at $2,500 a pop. Or you can do it once for $10,000. Or you do innumerable other combinations that add up to $10,000. But once you hit that $10,000 mark, you can’t ever take advantage of this tax-free, penalty-free distribution again.

    Penalty-Free Withdrawals

    In addition to tax-free, penalty-free withdrawals, you can also take advantage of penalty-free withdrawals in certain instances.

    However, since these are ONLY penalty-free distributions, your investment gains are still subject to income taxes if withdrawn.

    Below is a list of five (5) qualifying events in which the Roth IRA early withdrawal penalty is waived.

    1) Higher Education Expenses – You can withdraw funds from your Roth IRA early without penalty if you’re using the funds to pay for qualified higher education expenses for yourself, your spouse, your child, and/or any descendant of your child.

    So what are “qualified higher education expenses”?

    Tuition, fees, books, supplies, equipment, room and board, and some additional expenses at any eligible educational institution.

    Repayment of student loans are not counted as “qualified higher education expenses,” so make sure to do your homework. If you have questions, IRS Publication 970 outlines the rules and regulations governing Tax Benefits for Education.

    But remember, if you withdraw investment gains in addition to your original Roth IRA contributions, those investment gains are still subject to income taxes.

    2) Substantially Equal Periodic Payments – If you receive a series of “substantially equal periodic payments” based on your current life expectancy, you can avoid paying the 10% Roth IRA early withdrawal penalty. However, any investment gains withdrawn are still subject to applicable income taxes.

    3) Unreimbursed Medical Expenses – If you use the withdrawn funds to pay for unreimbursed medical expenses which exceed 7.5% of your adjusted gross income (AGI), then you can avoid paying the 10% Roth IRA early withdrawal penalty. However, any investment gains withdrawn are still subject to applicable income taxes.

    4) Medical Insurance Premiums – If you use the withdrawn Roth IRA funds to pay for medical insurance premiums after receiving unemployment benefits for more than 12 weeks, you can avoid paying the 10% Roth IRA early withdrawal penalty. However, any investment gains withdrawn are still subject to applicable income taxes.

    5) Payment of Back Taxes – The IRS allows you to withdraw funds from your Roth IRA early without paying the 10% early withdrawal penalty if those funds are used to pay off back taxes resulting from an IRS levy placed against you. However, any investment gains withdrawn are still subject to applicable income taxes.
