What is FHA and why is it important to the mortgage industry? The Federal Housing Administration (FHA) was established in 1934 to facilitate homeownership in the United States during the depression of the 1930’s. Its primary role was and is to insure FHA approved mortgage loans, protecting lenders from potential losses. With the backing of this governmental agency lenders can more confidently loan money in cases that, without this backing, the lender would not normally consider.

Traditionally, FHA insured mortgages were obtained as a low down payment option for first time homebuyers and others with little cash for a down payment. Once considered the ugly sister to the more popular conventional mortgage products, the number of new FHA insured mortgage loans have surged dramatically since the financial collapse of 2008.

What is an FHA insured reverse mortgage? In 1988, President Reagan signed the FHA Reverse Mortgage Bill into law which placed FHA, an insuring and regulatory body, in the reverse mortgage industry. Since 1988, FHA has insured over 1,000,000 reverse mortgages and FHA reverse mortgages account for at least 98% of all reverse mortgages in the U.S.

Very much like regular forward mortgages, FHA insures reverse mortgage lenders against foreclosure losses, thereby opening up the market to more possible reverse mortgage borrowers than would normally exist without FHA involvement.

Furthermore, acting as the regulatory body, FHA sets the rules for the entire industry and actively and prodigiously audits FHA approved lenders for compliance reasons.

At least 10% of all FHA loans are eventually audited by FHA for compliance purposes. Those lenders failing to comply with the set rules are subject to heavy fines and, if problems persist, a lender can be stripped of its FHA approved status. For most lenders, the latter penalty is tantamount to expulsion from the mortgage industry.

What is ‘Debt Consolidation’

Debt consolidation means taking out a new loan to pay off a number of liabilities and consumer debts, generally unsecured ones. In effect, multiple debts are combined into a single, larger piece of debt, usually with more favorable pay-off terms: a lower interest rate, lower monthly payment or both. Consumers can use debt consolidation as a tool to deal with student loan debt, credit card debt and other types of debt.

Methods of Debt Consolidation

There are several ways consumers can lump debts into a single payment. One is to consolidate all their credit card payments onto one new credit card – which can be a good idea if the card charges little or no interest for a period of time – or utilize an existing credit card’s balance transfer feature (especially if it’s offering a special promotion on the transaction). Home equity loans or home equity lines of credit are another form of consolidation sought by some people, as the interest on this type of loan is deductible for borrowers taxpayers who itemize their deductions. There are also several consolidation options available from the federal government for those with student loans.

BREAKING DOWN ‘Debt Consolidation’

Theoretically, any use of one form of financing to pay off other debts is practicing debt consolidation. However, there are specific instruments called debt consolidation loans, offered by creditors as part of a plan to borrowers who have difficulty managing the number or size of their outstanding debts. Creditors are willing to do this for several reasons – one of them being that it maximizes the likelihood of collecting from a debtor. These loans are usually offered by financial institutions, such as banks and credit unions; there are also specialized debt-consolidation service companies.

There are two broad types of debt consolidation loans: secured and unsecured. Secured loans are backed by an asset of the borrower’s, such as a house or a car, that works as collateral for the loan. More traditional, unsecured debt consolidation loans, which are not backed by assets, can be more difficult to obtain. They also tend to have higher interest rates and lower qualifying amounts. Even so, the interest rates are still typically less than the rates on credit cards. Also, the interest rate is fixed.

“Typically, the loan has to be paid off in three to five years,” says Harrine Freeman, CEO and owner of H.E. Freeman Enterprises, a credit repair and credit-counseling service in Bethesda, Md., and author of “How to Get Out of Debt.”

These types of loans don’t erase the debt; they simply transfer all your debts to a different lender or type of loan. (In circumstances where you need actual debt relief or don’t qualify for loans, it may be best to look into a debt settlement rather than, or in conjunction with, a debt consolidation. Debt settlement aims to reduce your obligations rather than just reducing the number of creditors. Individuals usually work with a debt-relief organization or credit-counseling service. These organizations do not make actual loans; instead, they try to renegotiate the borrower’s current debts with creditors.)

Advantages of Debt Consolidation Loans

Freeman says that debt consolidation loans are most helpful for those who have multiple debts, owe $10,000 or more, are receiving frequent calls or letters from collection agencies, have accounts with high interest rates or monthly payments, are having difficulty making payments or are unable to negotiate lower interest rates on loans. Once in place, a debt consolidation plan will stop the collection agencies from calling (assuming the loans they’re calling about have been paid off).

There may be a tax break, too. The Internal Revenue Service (IRS) does not allow you to deduct interest on any unsecured debt consolidation loans. If your consolidation loan is secured with an asset, however, you may qualify for a tax deduction. Debt consolidation loan interest payments are most often tax deductible when home equity is involved.

A consolidation loan may also be kind to your credit score down the road. “If the principal is paid down faster [than it would have been without the loan], the balance is paid off sooner, which helps to boost your credit score,” says Freeman.

How Debt Consolidation Works

For example, say an individual with three credit cards and a total of $20,000 owing at a 22.99% annual rate compounded monthly needs to pay $1047.37 a month for 24 months to bring the balances to zero. This works out to $5136.88 being paid in interest alone. If the same individual were to consolidate those credit cards into a lower-interest loan at an 11% annual rate compounded monthly, he or she would need to pay $932.16 a month for 24 months to bring the balance to zero. This works out to $2,371.84 being paid in interest. The monthly savings is $115.21, and over the life of the loan the amount of savings is $2,765.04.

Even if the monthly payment stays the same, you can still come out ahead by streamlining your loans. Say that you currently have three credit cards that charge a 28% APR; they are maxed out at $5,000 each and you’re spending $250 a month on each card’s minimum payment. If you were to pay off each credit card separately, you would be spending $750 per month for 28 months and you would end up paying a total of around $5,441.73 in interest. However, if you transfer the balances of those three cards into one consolidated loan at a more reasonable 12% interest rate and you continue to repay the loan with the same $750 a month, you’ll pay roughly one-third of the interest ($1,820.22), and you will be able to retire your loan five months earlier. This amounts to a total savings of $7,371.52 ($3,750 for payments and $3,621.52 in interest).

Data Visualization with JavaScript

It’s getting hard to ignore the importance of data in our lives. Data is critical to the largest social organizations in human history. It can affect even the least consequential of our everyday decisions. And its collection has widespread geopolitical implications. Yet it also seems to be getting easier to ignore the data itself. One estimate suggests that 99.5% of the data our systems collect goes to waste. No one ever analyzes it effectively.

Data visualization is a tool that addresses this gap.

Effective visualizations clarify; they transform collections of abstract artifacts (otherwise known as numbers) into shapes and forms that viewers quickly grasp and understand. The best visualizations, in fact, impart this understanding intuitively. Viewers comprehend the data immediately—without thinking. Such presentations free the viewer to more fully consider the implications of the data: the stories it tells, the insights it reveals, or even the warnings it offers. That, of course, defines the best kind of communication.

If you’re developing web sites or web applications today, there’s a good chance you have data to communicate, and that data may be begging for a good visualization. But how do you know what kind of visualization is appropriate? And, even more importantly, how do you actually create one? Answers to those very questions are the core of this book. In the chapters that follow, we explore dozens of different visualizations, techniques, and tool kits. Each example discusses the appropriateness of the visualization (and suggests possible alternatives) and provides step-by-step instructions for including the visualization in your own web pages.

The Book’s Philosophy

If you’re considering whether to invest your time and/or money in this book, it’s only fair that you should have some understanding of the philosophy guiding it. In creating the book, I’ve tried to follow four main principles to make sure the book provides meaningful and practical guidance.

Implementation vs. Design

This book won’t teach you how to design data visualizations. Quite honestly, there are other authors far better qualified than me for that. (You could do a lot worse than Edward Tufte for example.) Instead, we’ll focus on implementing visualizations. When appropriate, we’ll take a slightly bigger picture view to discuss the appropriateness of particular visualization strategies, but I recognize that sometimes the boss absolutely insists on a pie chart.

Code vs. Styling

As you might guess from the title, this book focuses on the JavaScript code for creating visualizations. We won’t spend much time discussing styles for those visualizations. Fortunately, styling visualizations is pretty much the same as styling other web content. Basic experience with HTML and CSS will serve you well when you add visualizations to your pages. The examples don’t assume you’re a JavaScript expert, and we’ll be sure to carefully explain any code more complicated than a basic jQuery selector.

Simple vs. Complex

Most of the book’s examples are simple, straightforward visualizations. Complex visualizations can be engaging and compelling, but studying a lot of advanced code is usually not the best way to learn the craft. In our examples, we’ll try to stay as simple as possible so you can clearly see how to use the various tools and techniques. Simple doesn’t mean “boring,” however, and even the simplest visualizations can be enlightening and inspiring.

Reality vs. an Ideal World

When you begin building your own visualizations, you’ll discover that the real world is rarely as kind as we’d wish. Open source libraries have bugs; third party servers have security issues, and not every user has updated to the latest and greatest web browser. We won’t ignore reality in these examples. Instead, we’ll see how to accommodate older browsers when it’s practical, how to comply with security constraints such as CORS. and how to work around bugs in other folks’ code.

The Book’s Contents

The chapters and appendices that follow cover a variety of visualization techniques and many of the JavaScript libraries that we can use to implement them.

  • The first chapter begins with the most basic of visualizations—static charts and plots. Its examples rely on the flotr2 library library.
  • Chapter two adds interactivity to the visualizations, giving users the chance to select content, zoom in, and track values. The chapter also covers retrieving data for visualizations directly from the web. For variety, and to give you a better sense of the options available, its examples are based on the Flot library. which is based on jQuery.
  • The third chapter looks at integrating multiple visualizations together and with other content on a web page; it uses the jQuery sparklines library.
  • With chapter four we consider visualizations other than standard charts and plots, including tree maps, heat maps, network graphs, and word clouds. Each example focuses on a particular JavaScript library designed specifically for one of those visualization types.
  • Chapter five covers time series data. It looks at several ways to visualize timelines, including traditional libraries; pure HTML. CSS. and JavaScript; and full-features web components.
  • In chapter six we consider geographic data, and we see many ways of incorporating maps in our visualizations.
  • Chapter seven introduces the powerful D3 .js library, a flexible and full-featured toolkit for building custom visualizations of almost any type.
  • Beginning with first appendix we consider other aspects of web-based visualizations. In particular, we can see how the Underscore.js library makes it easy to prepare the data that drives our visualizations.
  • The book concludes with the development of a complete single page web application that relies on data visualization. Here we’ll see how to use modern development tools such as Yeoman and the Backbone.js library.

Source Code for Examples

To make the text as clear and readable as possible, these examples generally contain isolated snippets of JavaScript, plus occasional fragments of HTML or CSS. Complete source code for all examples is available on GitHub .

Designing Your Auto Attendant

The most common mistake beginners make when designing an AA is needless complexity. While there can be much joy and sense of accomplishment in the creation of a multilevel AA with dozens of nifty options and oodles of really cool prompts, your callers have a different agenda. The reason people make phone calls is primarily because they want to talk to someone. While people have become used to the reality of auto attendants, and in some cases they can speed things up, for the most part people would prefer to speak to somebody live. This means that there are two fundamental rules that every auto attendant should adhere to:

Make sure you always include a handler for the folks who are going to press 0 whenever they hear an auto attendant. If you do not want to have a 0 option, be aware that many people will be insulted by this, and they will hang up and not call back. In business, this is generally a bad thing.

Before you start to code your AA, it is wise to design it. You will need to define a call flow, and you will need to specify the prompts that will play at each step. Software diagramming tools can be useful for this, but there’s no need to get fancy. Table 15.1, “A basic automated attendant” provides a good template for a basic auto attendant that will do what you need.

The Greeting

The first thing the caller hears is actually two prompts.

The first prompt is the greeting. The only thing the greeting should do is greet the caller. Examples of a greeting might be “Thank you for calling Van Meggelen and Associates,” “Welcome to Leif’s School of Wisdom and T-Shirt Design,” or “You have reached the offices of Dewey, Cheetum, and Howe, Attorneys.” That’s it—the choices for the caller will come later. This allows you to record different greetings without having to record a whole new menu. For example, for a few weeks each year you might want your greeting to say “Season’s greetings” or whatever, but your menu will not need to change. Also, if you want to play a different recording after hours (“Thank you for calling. Our office is now closed.”), you can use different greetings, but the heart of the menu can stay the same. Finally, if you want to be able to return callers to the menu from a different part of the system, you will normally not want them to hear the greeting again.

The Main Menu

The main menu prompt is where you inform your callers of the choices available to them. You should speak this as quickly as possible (without sounding rushed). [135 ] When you record a choice, always tell the users the action that will be taken before giving them the digit option to take that action. So, don’t say “press 1 for sales,” but rather say “for sales, press 1.” The reason for this is that most people will not pay full attention to the prompt until they hear the choice that is of interest to them. Once they hear their choice, you will have their full attention and can tell them what button to press to get them to where they want to go.

Another point to consider is what order to put the choices in. A typical business, for example, will want sales to be the first menu choice, and most callers will expect this as well. The important thing is to think of your callers. For example, most people will not be interested in address and fax information, so don’t make that the first choice. [136 ] Think about the goal of getting the callers to their intended destinations as quickly as possible when you make your design choices. Ruthlessly cut anything that is not absolutely essential.

Selection 1

Option 1 in our example will be a simple transfer. Normally this would be to a resource located in another context, and it would typically have an internal extension number so that internal users could also transfer calls to it. In this example, we are going to use this option to send callers to the queue called sales that was created in Chapter 13, Automatic Call Distribution (ACD) Queues .

Selection 2

Option 2 will be technically identical to option 1. Only the destination will be different. This selection will transfer callers to the support queue.

Religious education teaching that ‘Christianity is superior’

The government is being accused of breaching the Bill of Rights Act with religious instruction in schools.

The Secular Education Network has filed a case with the Human Rights Review Tribunal. saying the Education Act allows religious favoritism in state schools, which it says is prohibited under the Bill of Rights.

Its spokesman, David Hines, a retired journalist and lay preacher, said Section 78 of the Education Act allowed a school to hold religious instruction for up to an hour a week or 20 hours a year.

But he believed all religions should be taught in an academic way – the Christian religion should not be given preferential treatment – and the impact could be damaging for other people.

“It’s a spit in the face for every other religion, it is saying that Christianity is superior,” he complained.

“It is telling the Jews that the Bible is a Christian book when the Jews have substantially the same book but put a different interpretation on it.

“It is a put down for atheists because it says you have got to believe in God to live a good life.”

David Hines has gathered 26 witnesses for his case, including 13 parents who said their children were mistreated.

One of them is Tanya Jacob, who had to pull her children out of their school in Christchurch.

“We knew there were going to be these bible classes so we thought we would just opt out,” she said.

“Over time we found that our kids were being put back in (to the class) and we found they were being told they were going to Hell.

“They were also being badgered for not believing in God.”

Joining the case along with Mrs Jacob were leaders from five religions saying their beliefs were misrepresented.

Another witness was Paul Morris, Professor of Religious Studies at Victoria University.

He examined three religious instruction courses used in schools and found defects in all of them.

“They present Christianity from an evangelical perspective,” he said.

“The teachers’ guides include prayer sessions, thanking God for the Bible, thanking God for the miracles, they do not address students who come from different faith worlds.”

The Christian Education Council issued a statement defending its position.

The council, whose expressly stated aim was to equip and inspire children through values-based Christian religious education, said more than 600 schools throughout New Zealand invited in its religious instructors each week.

It said it was the largest provider of religious instruction in the country, and was passionate about its continuation in New Zealand’s state schools.

However, Mr Hines argued that the religious instruction being done by this group was not, strictly speaking, legal.

He said the Bill of Rights Act prohibited state institutions from favouring one religion over another, but the Education Act allowed exactly that.

“Those two laws are in conflict with each other,” he said.

“And we are asking the tribunal to make a ruling that the laws are inconsistent, and send a report to parliament saying they should consider changing the law.”

Mrs Jacob said she pulled her children out of school for religious instruction that should not have existed, she said.

“It’s got nothing to do with normal education,” she said.

“If you want your children to be brought up in a faith, then you take them to church or the temple or a mosque.

“That is not for school time. All our kids should be able to go to school without being made to believe in things or be harassed for not believing in things.”

The attorney general was not commenting on the upcoming hearing, nor was the Ministry of Justice, except to confirm that a case has been filed.

No date for a hearing has been set but the battle lines have been drawn, with senior lawyers, including a QC, hired for representation.

T-SQL Programming Part 8 – Removing Rows with the DELETE Statement in SQL Server

Greg Larsen explores how to remove rows from a SQL Server table using the DELETE statement.

In my last two articles I discuss using the INSERT and UPDATE statement. These two commands added new rows and modified existing rows. In this article I will explore how to remove rows from a table using the DELETE statement.

Syntax of the DELETE Statement

You may want to delete rows because they are no longer needed, or they were incorrectly added in the first place. The DELETE statement is used to remove rows from a SQL Server table. A single DELETE statement can remove a single row, or number of rows. Here is the basic syntax of the DELETE statement.

( expression ) – is a number or an expression that equates to a number used to limit the number of rows deleted

object – is the name of an object in a database from which you want to delete records

OUTPUT Clause – identifies the column values of the deleted rows to be returned from the DELETE statement

search_condition – the condition used to identify the rows to be deleted

For the complete syntax of the DELETE statement refer to Books Online.

In order to demonstrate how to use the DELETE statement I will be creating a DemoDelete table. Here is the code I used to create and populate my DemoDelete table.

Deleting a Single Row Using WHERE Constraint

In order to delete a single row from a table you need to identify that row with a WHERE constraint. Below is some code that deletes a single row from my DemoDelete table:

In this code I used the DeleteDesc column to constrain the records that I would be deleting. By specifying that the DeleteDesc column value had to be equal to the value “The Mother”, only one record in my table got deleted, because only one row in my table had that value. Now if my table contained a number of rows that had a column value of “The Mother” then all the rows that contained that value would be deleted.

If you are unsure of the rows you are identifying to be deleted using the above example, and you want to make sure the rows you have targeted with the WHERE constraint are correct, then you can first run a SELECT statement. After you are confident that your SELECT statement is selecting the rows you want to delete you can then convert it to a DELETE statement.

Using the TOP Clause to Delete a Single Row

You can also use the TOP clause to delete a single row. Below is an example where I used the TOP clause to delete one row from my DemoDelete table:

This statement deleted a random row from my DemoDelete table. It was random because SQL Server does not guarantee a sorted set will be returned where it can delete the top record of the ordered set. When I review the records left in my table I see I deleted the record that had an Id value of 1 and a DeleteDesc of “Thing One”. Note if I change the TOP clause to another number like 3, then this statement would delete the number of rows equal to the value specified.

Deleting the TOP 1 Records from a Sorted Set

If you want to delete the first record from a sorted set you need to write your TSQL DELETE statement similar to the following code:

In the above code I create a subquery that returned a single ID value based on the descending sort order of ID column value in my DemoDelete table. I then used the WHERE constraint to only delete records that had that ID value. I also place a TOP (1) clause on my DELETE statement to only delete a single row should my DemoDelete table contain multiple records with the same ID value. Since my DemoDelete table did not contain multiple records with the same ID value I could have also deleted the largest ID value row by running the following code:

When I run this code against my DemoDelete table it will delete ID value of 5.

Using Another Table to Identify the Rows to Delete and the OUTPUT Clause

There are times when you might what to delete the rows in a table based on values from another table. An example of where you might want to do this is to remove rows from your inventory table based on some sales data. To demo this first I will need to generate another table that contains key values for the rows I want to delete. Here is the code to create and populate my other table:

At this point after running all my different DELETE statements against my DemoDelete table there are only three rows left in my table. By selecting all the rows in my DemoDelete table I see that these three rows are left:

In order to use the RecordsToDelete table to delete specific records in my DemoDelete table I need to run the code below.

This code joins the table DemoDelete and RecordsToDelete based on the DeleteDesc column. When the DeleteDesc matches between the two tables the matched rows within the DemoDelete table are deleted.

My delete statement above also contains the OUTPUT clause. The OUTPUT clause is used to return the column values of the deleted rows that are identified in the OUTPUT clause. In the code above I specified “DELETED.*”. The “*” means to return all the columns values from the DELETED rows. When I ran this code the following rows were returned:

These returned rows could be used by your application for some purpose, like creating an audit trail.

Inserting OUTPUT Clause Data into a Table

There are times when you might retain the data created by the OUTPUT clause in a table instead of just returning the deleted row values to the application. To demonstrate running a DELETE statement that populates the row values being deleted into a table I will run the code below.

The following output displayed the SELECT statement in the above code snippet:

In both of my examples that used the OUTPUT clause of the DELETE statement I specified “DELETED.*” to denote outputting all the column values for the rows being deleted. I could have specified the actual column values I wanted to output. The code below is equivalent to the code above.

In this code you can see I specified “DELETED.ID, DELETED.DeleteDesc”, instead of “DELETE.*”. You can verify this code is equivalent by inserting the “The Cat” row back into the DemoDelete table and then running the code above.

Multiple Ways to Delete Rows

As you can see there are multiple ways to delete rows from a SQL Server table. You can use the WHERE clause to identify specific criteria for the rows that need to be deleted. You can join a table to the table in which you are deleting rows to identify which rows to delete. You can even use the TOP clause to restrict the number of rows that will be deleted. The article should help you with developing your DELETE statement next time you have to remove some rows from a SQL Server table.

Master of Legal Studies ( M.L.S. )

The Master of Legal Studies (M.L.S) degree is a 36 unit, two-year graduate program for individuals who desire to obtain an advanced knowledge of the law and the American legal system, but who do not wish to become lawyers. The degree program is designed for individuals in careers that involve interaction with lawyers and the legal system and for those who are entering professions where an understanding of legal reasoning and the legal system will improve their professional effectiveness. The M.L.S. degree program can be valuable to individuals in fields such as law enforcement, public administration, financial services, human resources, healthcare management, government regulation, non-profit management, court administration, and social services. M.L.S. students attend law courses that are part of the regular law school curriculum and are held to the same standards for attendance, participation, and grading as law students.

Admission Requirements

  1. Submission of a completed M.L.S. Degree Program Application form and payment of the non-refundable application fee.
  2. Completion of the required undergraduate course of studies in an academic (non-vocational) program. For details of the undergraduate requirements, contact Dean of Admissions Wendy LaRiviere at wlarivier u or 831-582-4000 ext. 1012.
  3. Official transcripts for all college, graduate school, and professional schools attended by applicant.
  4. Two letters of recommendation.
  5. A personal statement on how the M.L.S. degree will advance the applicant’s professional or academic objectives.
  6. Please note that the admission requirements and admission application for the M.L.S. degree program is different than the concurrent MLS/JD degree program. Applicants interested in the concurrent MLS/JD program must meet the admissions requirements for that program and submit a MLS/JD application.

Applicants for the M.L.S. degree program are not required to take the LSAT, GRE, GMAT or other graduate admissions tests. If an applicant has taken one of these standardized graduate admissions tests, they are encouraged to include the scores on their application. Foreign applicants of non-English background may be required to take the Test of English as a Foreign Language (TOEFL) and submit their official scores to MCL. Decisions on admissions are made on the basis of a “full file” review that includes each applicant’s previous academic record, test scores (if required or submitted), work experience, personal and professional recommendations, and a personal statement.

Program Requirements

  1. Completion of 36 units of graduate legal studies. A minimum of 18 units must be completed in residence at Monterey College of Law. Students are allowed flexibility in selecting courses in order to provide the opportunity to focus on specific areas of legal interest. There are 25 units of required courses and 11 units of electives.
  2. Required Courses (units): Contracts (6), Torts (6), Criminal Law (3), Constitutional Law (6), Legal Research (2), and Legal Writing Analysis (2).
  3. Elective Courses: The 11 units of electives may be selected from other law courses that are offered as part of the regular law curriculum (subject to pre-requisites for certain advanced law courses). In addition to regular law courses, elective units of clinical programs, research and writing, study abroad, or pre-approved independent study courses may be counted toward the degree requirements.
  4. A written project of a 5,000 to 7,500-word paper on a pre-determined legal issue is required.
  5. M.L.S. students are required to meet the same attendance requirements and are held to the same standards for class preparation and participation as regular law students.
  6. M.L.S. students are subject to all administrative policies, including the Student Honor Code, exam procedures, registration, payment of tuition and fees, academic disqualification, and grade appeals that are contained in the Student Handbook and are not specifically directed to the J.D. program.
  7. No units earned as part of the M.L.S. program are eligible to be applied toward the J.D. degree program, unless the student is enrolled in the concurrent MLS/JD program. A student in the J.D. program or the concurrent MLS/JD program may petition the Academic Standards Committee to request a transfer to the M.L.S. program.

Grading Standards

During their course of study, M.L.S. students will not be identified separately from J.D. students in courses, examinations, or the grading process. All papers, assignments, and exams will be graded using the MCL system for assigning student or exam ID numbers that protect student identity and ensures anonymous grading.

Administration Student Advising

The M.L.S. degree program will be under the academic direction and supervision of the MCL Dean or his designee. The regular departments of MCL will provide all other administrative services.

Faculty

Since all M.L.S. courses are regular J.D. courses, the faculty for the M.L.S. degree will be the same as for the J.D. program.

Scholarships, Awards Student Loans

Students in the M.L.S. program shall be eligible for scholarships, awards, and student loans. In some cases the students will be eligible for the same categories as regular J.D. students. For certain awards, special recognition will be developed for M.L.S. students.

Courses:

Required Courses (25 Units)

Contracts. This class covers enforceable agreements including requirements for the formation of a contract; problems of interpretation, consideration and its equivalent, damages for breach, the statute of frauds, illegality, and rights and liabilities of third parties arising from the contract itself or from assignment of contractual rights or delegation of duties.

Criminal Law. (3) Topics include substantive criminal law and elements of criminal responsibility, law of crimes against persons, property, and habitation, the theory of criminal responsibility, parties and defenses to crimes.

Torts. (6) The historical development and nature of non-contractual civil law that allocates the economic burden of various injuries. A study of the principles of liability for physical harm under theories of negligence, intentional torts, and strict liability, including the law governing defamation, invasion of privacy and other relational harms.

Constitutional Law. (6) A study of the United States Constitution with an emphasis on the theory and practice of judicial interpretation and review. Topics include the separation of federal powers, the relation of the federal government to the states and specific government powers (tax, treaty, war and commercial). The course also covers limitations placed on the exercise of governmental power, emphasizing the Bill of Rights, due process and equal protection clauses.

Legal Research. (2) A class to familiarize students with the basic foundations of legal research. Assignments include researching problems in the law library and researching and writing office memoranda, opinion letters and other documents. Computer assisted legal research is included.

Legal Writing and Analysis. (2) A course designed to improve analytical and written communication skills. Students work on simple legal problems, learning how to identify and analyze legal issues and express their legal reasoning. Assignments include exercises in case briefing, exam writing and drafting legal memoranda.

Elective Curriculum

The 11 units of electives may be selected from other law courses that are offered as part of the regular law curriculum (subject to pre-requisites for certain advanced law courses).

In addition to regular law courses, elective units of clinical programs, research and writing, study abroad, or pre-approved independent study courses may be counted toward the degree requirements. In certain circumstances, pre-approved, law-related graduate courses may be transferred from other law schools or graduate institutions and applied to the 36-unit graduation requirement. A minimum of 18 units must be completed in residence at Monterey College of Law.

You can get a free credit report. But do you know how to read and understand it? This interactive guide will help. First we’ll look at how to acquire your report, then how to read and understand it once you get it.

One free report every 12 months
Everyone is entitled by law to look at their credit report from each of the three credit bureaus once every 12 months free of charge, or you can buy a credit report from each of the three bureaus if you want to view your report more often.

The three large U.S. credit bureaus — Equifax, Experian and TransUnion — were required by a 2003 federal law to set up AnnualCreditReport.com as a central online resource for report requests. You can also request your reports by calling 877-322-8228 or by downloading a request form and mailing it to:

Upon visiting AnnualCreditReport.com, users are directed to a form page and asked to provide personal identifying information, including name and address, Social Security number and date of birth.

After submitting your basic information, you go to a page allowing you to select reports from the three large credit bureaus by checking boxes next to the Equifax, Experian and TransUnion logos. You can select one or all of the credit bureaus. Instructions discuss whether you should review all three reports immediately, or whether you should spread the requests over a period of time.

The next step is designed to verify your identity. A page of questions appears about your creditors, loan terms or other details on the credit report that you’re expected to know. You need to select the correct answers get access to the credit report. The AnnualCredit.Report.com site is integrated with the websites of the credit bureaus, making the transition from one to the other seamless. After requesting one report, you may return to the main site to repeat the process with another credit bureau.

Many consumers have a difficult time understanding their credit reports and piecing the three reports together, so here are examples and explanations of the most common elements that appear in each of the three free credit bureau reports. Roll over the information icon () for explanations.

Personal information is identifying information about the credit report requestor. Experian and TransUnion include this information at the beginning of your credit report, while Equifax puts it at the end of its report.

A report number is generated by the three credit reporting agencies as a reference for consumers to use if they should need to contact the issuing bureau. Note this number when you need to contact Equifax, Experian or TransUnion online, by phone or by mail.

Mesothelioma Lung Cancer

Lung Cancer is a tumor that develops within the lungs. It is usually a single growth unlike mesothelioma, which spreads across the pleura surface outside the lung, in the form of many small tumors. Asbestos fibers in the lungs can contribute to the development of lung cancer. usually in concert with a history of smoking. But asbestos is just one of many factors in Mesothelioma lung cancer development; it is the only known cause of mesothelioma.

Mesothelioma – A Cancer with a Single Cause

Various parts of the mesothelium have various names: the peritoneum is the portion of the mesothelium that covers the wall of the abdominal cavity. The pericardium is a sac around the heart. Mesothelioma may develop in either of these locations as well as in the pleura. In each of these cases the cancer is usually diffuse, being an array of small tumors rather than a single large growth.

Because seventy percent of all diagnosed cases of mesothelioma develop in the outer lining of the lungs, it is best known as a cancer that affects the lung area. Some of the symptoms for pleural mesothelioma are similar to those that accompany lung cancer: a chronic, dry cough, chest pain, shortness of breath, and pressure within the chest. Lung cancer can trigger pleural effusion, an accumulation of fluid common to pleural mesothelioma.

However lung cancer as it is traditionally understood is cancer that causes usually a single tumor in the lung. Pleural mesothelioma causes tumors to develop on the surface of the pleura, small tumors over a diffuse area across a thin layer of tissue outside the lung. Pleural mesothelioma and lung cancer are two different forms of carcinoma .

Peritoneal mesothelioma has its own set of unpleasant symptoms generally unrelated to those that accompany lung cancer. Abdominal swelling and pain are common; so are gastrointestinal problems. Pericardial mesothelioma creates symptoms that are very similar to those seen with cardiovascular disease such as irregular heartbeat, heart palpitations and severe shortness of breath.

When Asbestos Causes Lung Cancer

Asbestos is also recognized as a potential primary cause for lung cancer ; in fact the way asbestos most often enters the body is through the lungs. Tiny asbestos fibers that have broken off from an asbestos product that is being manipulated or is deteriorating can float in the air like tiny dust particles and be inadvertently inhaled.

These fibers cannot be shed by the body and eventually work their way through the lung to the pleura, the lining outside the lungs. In some instances asbestos fibers stay in the lung and cause asbestosis or worse, the development to malignant cells which become the foundation for asbestos and lung cancer. Asbestos fibers may be a primary cause for lung cancer or a contributing cause, as with cigarette smokers. Far more cases of lung cancer have primary causes that are smoking related.

Like many forms of asbestos cancer mesothelioma may metastasize in its late stages and cause the development of tumors in other areas of the body. Late stage mesothelioma may cause tumors to develop within the lungs ; at this point the patient has mesothelioma as the primary form of cancer and lung cancer secondary to pleural mesothelioma .

Asbestos can contribute to everything from bronchitis to emphysema, but there are three diseases for which it can be a primary instigator – all of which can be fatal:

There is no doubt that in past generations mesothelioma was often misdiagnosed as lung cancer by a physician or coroner filling out a death certificate. The frequency of asbestos-caused lung cancer today can be interpreted in many ways.

Ninety percent of all lung cancer cases are primarily attributable to smoking. However second-hand smoke, industrial pollution of all types and radon gas are among significant contributors to the likelihood of lung cancer. The same is true of asbestos. According to one medical source, asbestos exposure increases the risk of lung cancer by nine times. A combination of asbestos exposure and cigarette smoking raises the risk fifty to eighty four times over just smoking.

When it comes to freight brokers contacting new prospects and building a new relationship, it may seem daunting if not overwhelming. What do you say to your new contact? How often should you be in touch with a new prospect? How do you know if you are making the right choices moving forward or setting yourself up for failure?

    Over time, freight brokers learn what works and what does not. But it takes time and usually a long time. Meanwhile, many prospects (and opportunities) have been lost in the learning process. Below are some ways that can help freight brokers new to the industry save on time and effort and propel them quicker towards success. As for the more seasoned freight broker, these tips can serve as a refresher to help improve their game…and overall results!

    Here are 6 lead generation tips to help freight brokers obtain quality leads:

    1. EVERY DAY, obtain THREE new business contacts (and call them): FACT As with most any industry, you will lose business for one reason or another. These new contacts will help to replace business that you will eventually lose or business that will never get off the ground (like the dreaded 1-shipment only customer). Some customers will not have any loads for 6 months or a year and then recontact you. Others will fall through for other reasons, so it’s important that you continually seek and pursue new prospects.

    2. Do your research BEFORE you make the call: Cold calling people without doing any research tells them you did not consider the call important enough. The key here is to understand that it is not about you it is all about them. Make sure the conversation is about them, not you. Use sales intelligence to turn a cold call into a warm call. Sales Intelligence refers to technologies and practices for collection of information to help sales people keep up to date with clients and prospects. Use Google and other search engines to gather relevant information (i.e. articles featuring the company and/or executives, recent awards or recognitions, and company locations).

    To get information on your prospect s company, begin by calling their sales department. Salespeople are great individuals to talk to when you want to know everything about a company and where it’s going. You can gain a great deal of knowledge from salespeople, so use that opportunity to ask them questions about what they do and how they do it. Ask them what lanes they ship, or what states they operate in.

    3. Build a relationship: Establish rapport with your contact and foster a connection. It’s no secret people are more likely to buy from a friend than from someone they view as a salesperson. This can be difficult to achieve at first when making cold calls. One way freight brokers can establish rapport is to start the conversation based on the lane they are running or the weight they are moving. This is great information to use to help make that initial connection with prospects. You will naturally learn how to build rapport as you learn the ins and outs of their business and the individual him or herself. Try to think of the process as being on a football team: you start as a freshman and build your skills through training and practice.

    4. Expect resistance from prospects: You WILL hear excuses such as “business is slow” or “we don’t have any loads that need to be moved. But don’t give up! Persistence is key. Remember to ALWAYS follow up with your prospects/customers.

    5. Take ACTION and follow through: You’ll build proficiency through ACTION. The process will get easier and you will get better at connecting, but you have to put in the time and effort.

    6. Stay FOCUSED: Keeping your focus is crucial. Stay focused on the three p s: the people. the process. and the product. When you focus on the three most important aspects of business, you WILL have a successful freight broker business and/or be a successful freight broker agent for years to come!

    The ability to control temperature is a vital notion of any radiant heating system. A sensible control system ensures that the system functions efficiently and maximizes overall comfort of the radiant heated floors. One of the temperature control methods commonly used is injection mixing.

    Injection mixing is an easy method to maintain the desired temperature and heat output by controlling the rate of hot water injected into the system. This method works best in low-temperature radiant floor heating systems.

    As the water circulates in PEX pipe and outputs heat, it tends to get cooler, requiring the heat level to be raised in order to maintain a set temperature. The heat output is increased by injecting hot water into the system where it is mixed with the colder water at the “mixing point”. Ideally, an exact amount of hot water will be supplied that when mixed will result in the desired temperature. An example of injection mixing would be injecting hot water at 190F into the loop with the current temperature of 100F, in order to increase it to the set level of 115F.

    Hot water injection is not constant and the water enters the system only when additional heat input is needed. The flow of water injection is what controls the temperature of the whole circuit. Increase in injection flow rate will increase temperature and result in increased heat output of the radiant heating system. Naturally, the higher the temperature of the injected water, the lower flow is needed. As a result, the water is usually injected at a very low flow rate, since the temperature in the circuit needs to be raised only by a few degrees, while the temperature of injected water is much higher than that.

    Since the loop is completely filled with water, injecting new water into it will result in the same amount of water that is already in the system to be pushed out through the return outlet at the same flow rate.

    One of the most common ways of applying the injection mixing process is in systems with 2-way valves. Such systems consist of a distribution loop (regular PEX tubing circuits), as well as a boiler loop, which is run at high temperatures. The two loops are connected by supply and return injection risers, with a 2-way valve installed on a supply riser. The valve is connected to a sensor, which is attached to a PEX tube. As the temperature in the sensor starts to fall, it sends a signal to open the 2-way valve to allow inflow. The valve is shut off as soon as the sensor reads that the set temperature has been achieved. A flow restrictor is positioned between the two risers; its role is to create a pressure drop that would allow the hot water to enter the loop, once the valve is open.

    The boiler loop is used to mix hot water with cold water from the return riser. The mixing increases the water temperature before it returns to the boiler and ensures that water with very low temperatures doesn’t enter the boiler.

    Options Strategies And Your IRA Account

    I receive many responses from readers of my option strategy articles. Recently one question keeps popping up, though in various forms. Do these strategies work with IRA accounts?

    The simple answer is YES, to an extent. In some cases options actually work better in an IRA than in a taxable account.

    One of the most common option strategies is the selling of a naked put instead of actually buying the underlying stock. The taxation of gain on any security (including options) that is sold short is at ordinary income rates. In an IRA this doesn’t matter as there is no current tax and all distributions are taxed at ordinary rates regardless of their initial source. So, from an IRA taxation standpoint there is no difference in selling puts and buying stock (though there may well be a difference in investment result).

    In a taxable account the same doesn’t necessarily hold true. If you hold a stock long enough the dividends and any gain can be taxed at the lower long-term capital gains tax rate. Shorting a put is always taxed at ordinary rates and can be significantly higher. This is a factor that can reduce your net after-tax yield and should be factored into your planning.

    Putting taxation aside, there are several limitations in IRA accounts you need to deal with. First is the margin account. Your IRA must establish a margin account if you are going to employ any strategy other than simply buying calls or puts. This is generally not a big deal but does require proper trading authority from the compliance department of your broker.

    The simplest level of authority allows the selling of covered calls. This is really more of a stock strategy than an option strategy but I include it.

    Next is the selling of “cash secured puts”. This is relatively easy to understand. Let’s say you want to buy 1000 shares of a stock trading at $15. This would require $15,000 in cash. Instead of an outright purchase you could chose to sell 10 puts (each put controls 100 shares). Your exposure is no greater than having bought 1000 shares for $15,000 and you need only “reserve,” or set-aside $15,000 of cash to enter this transaction. In essence, there is no leverage.

    This is different than margin in a taxable account that can require as little as 25% in margin. Taxable margin accounts increase the leverage as much as four-fold. This is either good or bad, depending on which side you land on.

    An additional limitation in an IRA account is the prohibition against short selling. Selling “naked calls” is similar to shorting the underlying and prohibited in IRAs. In a taxable account you can sell naked calls and just need to deal with margin requirements.

    This means that those strategies that include selling naked calls can’t be used.

    Strategies so limited include straddles, strangles, synthetic shorts and other derivations. Let’s say you wanted to sell a “straddle” on a particular underlying stock. This would require you to sell a put and a call at the same strike (usually at the same expiry, but not required). In a taxable margin account this would be permitted. The trade is “paired” and the margin requirement is computed on just one of the legs: the larger of the two.

    This can be a very useful tool when a trade entered by selling a put turns against you. Selling a call can offset or reduce further losses. You use little or no margin. This can’t be done at all in an IRA margin account as a naked call can’t be paired with a put (it can be paired only with a long call).

    Some readers might just “zone out” when talk turns to straddles and strangles. They often understand what they are but might not really understand how they can be used. Straddles and strangles can provide one of the easiest and most productive hedges available. Readers may want to review my article on using a strangle to hedge XLE to see these strategies in action. Unfortunately this technique isn’t available in IRA accounts.

    This leads us to the available option strategies—spreads. Included in these are calendar spreads, diagonal spreads, vertical spreads and certain butterfly and condors that fully pair options. This requires a higher trading authority.

    Let’s examine a vertical bull put spread to see the advantage of this higher trading authority. This strategy consists of selling a put at one strike and buying a protective put at a lower strike (both with same expiration). An example would be a stock trading at $25. You could sell 10 out-of-the-money puts with a strike of $24 and buy 10 protective OTM puts with a strike of $20.

    If you did not have the higher trading authority it would break down as two separate transactions. 1) a cash covered put requiring $24,000 in reserve ($24 times 1000 shares) plus 2) a cash buy of the lower strike put. With the higher authority the margin requirement is simply the difference in strikes ($4) times the number of shares (1000) or $4,000.

    Many of my portfolio strategies consist, in part, of buying far dated options and selling near dated or weekly options (calendar spreads). These spreads are all permitted in an IRA account and one need only take into account available margin balances. The IRA margin calculation for a calendar spread is the same as the vertical put. It is just the difference in strikes times the shares. So, if you bought 10 September OTM calls at $24 and sold 10 OTM December calls at $19 your margin requirement is $5000 ($5 strike differential times 1000 shares).

    If you sold a call at a higher price than the one you bought, there is no margin requirement, just cash. It is viewed very much the same as a covered call.

    Additionally, if you sell a put at a lower strike than the one you bought there is no margin, just cash.

    Whenever spreads are used in an IRA account a trading complexity can exist.

    Let’s say your IRA had $100,000 in total value broken down to $60,000 in stocks and $40,000 in cash. Let’s further say you wanted to enter into a bull put spread for 10 options on SPY (currently trading at $125). You sell ten OTM puts at a strike of $123 and buy ten protective OTM puts with a strike of $120. Your margin requirement is only $30,000 ($3 strike differential times 1000 shares) and well within your cash balance.

    A snake lays waiting for you in the brush. Let’s say SPY drops and your ten puts are assigned. This means 1000 shares are bought at $123 for a total cost of $123,000 and you only have $40,000 in cash.

    This isn’t too big a deal in traditional margin accounts as you can use margin to sell the shares. It doesn’t work that way with IRA margin and this presents a problem that may require you to liquidate other securities and suspend your trading privileges. You need to discuss how your broker will handle this to be sure you aren’t further restricted.

    This requires constant monitoring of the extrinsic value of the option to determine its likelihood of assignment. When the extrinsic approaches just a few cents the assignment likelihood increases. If the likelihood is great, you need to pre-mpt the assignment by rolling the option beforehand. If you just use cash secured puts you never have to worry about assignment as there is always enough money to cover the assignment.

    A similar problem can occur if you sell a call as part of a paired strategy and the call is assigned. You end up being short the underlying. Since IRAs can’t be short you need to cover the short immediately and need enough cash in your account to do so. If you don’t have enough cash you may encounter a trading violation and that restricts your future trading.

    When various spreads allow you to trade options with a “sticker price” in excess of your account value (leverage) you need to monitor them carefully to make sure they aren’t assigned.

    In conclusion, if you can secure the necessary trading authority many of the option strategies will be available to you. Margin requirements will restrict some of the leverage available when compared with taxable accounts. Assignment can also become a greater problem than a taxable account and requires monitoring. These are not major obstacles, but ones that need to be kept in mind.

    Entry Requirements

    To enter the program, you will need to possess a valid driver s license, be able to pass a criminal background check, and not be prohibited by state or federal law from possessing a firearm. You must pass a psychological exam that would certify you would not be a harm to yourself or others. You must pass a physical exam which indicates you have sufficient strength, flexibility and cardiovascular endurance to satisfactorily complete the firearms, defensive tactics and patrol tactics included in the skills portion of the program.

    Work Environment

    The law enforcement courses help students develop the academic and technical skills needed to assume entry-level positions as licensed peace officers in Minnesota. Work environments vary depending on the agency and the assignment.

    Job Outlook / Gainful Employment

    The job market is competitive. We recommend our students to be a well-rounded candidate. Many students have volunteered in the community, speak a second language, or have experience outside of the law enforcement field.

At the undergraduate level, we offer a Bachelor of Arts in Psychology with either a general focus or a specialization in mental health, and a Bachelor of Science in Psychology with tracks in Behavioral Neuroscience, Cognitive Science, and Assessment Applied Psychology. At the graduate level. we offer a 30-credit Masters of Arts in Psychology.

    • Contact the professor of the class for permission, with the following exceptions:

    • Note that many of our popular classes fill quickly and cannot be overenrolled. You should not assume that you’ll be able to add a class that is full.

    Do you want to switch to a different catalog year.

    Requests for a catalog switch need to be entered by the chair of your major department.

    You may need to switch your catalog for one or more of these reasons:

    • You just returned to SCSU after an absence, and you want to follow the curriculum rules from when you first started at SCSU (for example, the older Gen Ed requirements or older Psychology requirements)
    • You want your degree evaluation to reflect changes to the Psychology major that went into effect after you started (for example, the revised BS in Psychology that started in Fall 2016
    • You want to take advantage of changes to the LEP that go into effect in Fall 2017. For Psychology majors, these are:

    — You can skip one of the following Tier 2 categories. American Experience, Creative Drive, Cultural Expression, Global Awareness, Social Structure, and Time Place.

    — If you transferred with 30-59 credits. you can waive the World Language requirement if you took two semesters of a language in college (e.g. SPA 101), or three levels’ worth in high school (e.g. equivalent of SPA 200)

    — If you transferred with 60 or more credits. the World Languages requirement is waived.

    *** If you have between 30-59 transfer credits and you hope to waive the LEP World Language requirement, you need to also submit the LEP WLL Waiver Request Form to the LEP office. You may need to include additional documentation regarding high school courses. (This is separate from our departmental request form.)

    *** If you are changing your catalog year for any other reason (including if you have 60+ transfer credits and want a WLL waiver), you only need to submit the request form to Dr. Brancazio.
